Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is the first trial to be held since J&J filed for bankruptcy and spun off its talc division.

In the first quarter of this year, large settlements were made in talc lawsuits in New Jersey and California. Plaintiffs linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a lethal form of cancer is a disease of the mesothelium the lining that surrounds organs and cavities in the body. It is most common in the lungs but can also be found in the chest and abdomen cavity. Asbestos is the sole known cause of mesothelioma, and people who have been exposed to asbestos are at a higher risk of developing this disease.

The first trial after J&J declared bankruptcy on its talcum-powder division opened in Oakland, California this week. Jurors were impressed by the story of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial mesothelioma in 2022. He attributed the cause of his condition to his use of Johnson & Johnson Baby Powder. The jury awarded him $25 million.

J&J is accused of hiding asbestos risks from consumers for several decades. The company has a long history of obstructing asbestos research from regulators and funding asbestos tests to generate the results it desired. These lawsuits have identified several of the company's suppliers of talcum powder, including Whittaker Clark & Daniels, Imerys Talc America, and others.

Some women who used talcum to provide feminine hygiene on sanitary pads or condoms or in the genital area have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than forty years that the powder could trigger ovarian cancer and other diseases, but failed to warn consumers.

Mesothelioma symptoms include abdominal pain and abdominal swelling, abdominal lumps and persistent coughing. Doctors can detect mesothelioma with an examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.

When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. Duluth mesothelioma lawyers can remove affected tissue based on the location of the tumors. Patients with mesothelioma may have a life expectancy less than five. However, aggressive treatments such as extracorporeal tissue transplantation and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong survival.

What Causes Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA changes in a cell. These mutations cause the cells to multiply rapidly, forming tumors in the tissues of the body. Asbestos is a common cause of mesothelioma. Asbestos exposure can be found in a variety of fields, including mining, manufacturing construction, transportation and construction. Asbestos is usually exposed for between 20 and 40 years prior to the onset of symptoms developing. Men are more likely to develop mesothelioma than women. It is also most often diagnosed among those between the ages of 50 and 70. The kind of mesothelioma caused by asbestos that a person develops is usually determined by where they were exposed. The majority of patients diagnosed with pleural msothelioma, which affects the lung. Some are diagnosed with peritoneal msothelioma. This type of mesothelioma affects the abdomen. Certain people are diagnosed with pericardial msothelioma. This is an extremely rare type of cancer that affects both the liner (pericardium) as well as the organ itself.

Shortness of breath, fatigue, and abdominal pain are all signs of mesothelioma. In the latter stages of mesothelioma the tumors can grow to other areas, causing severe discomfort and pain. Other symptoms that are common to mesothelioma include swelling of the lungs (pleural effusion) and a loss of appetite, difficulties swallowing and a blockage within the small intestine, referred to as a bowel obstruction. Mesothelioma is a fatal illness, and it is often fatal.

The talcum-powder case in Oakland involved a man of 24 years old who was diagnosed with pericardial msothelioma after using J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos and didn't warn consumers. They also cited a 1998 letter sent to a J&J executive that revealed the possibility of asbestos being in their products.

This is the latest in a string of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who contracted ovarian mesothelioma from J&J's talcum powder. Then, last month the jury in Missouri awarded $55 million in a separate case involving the same issue. In addition, seven cases were added to the powder's MDL over the last month and brought the number of pending lawsuits to 37,522. The majority of these lawsuits concern women who used J&J's Talcum powder for feminine hygiene reasons.

How can I tell if I have mesothelioma or not?

A diagnosis of mesothelioma can be devastating. Patients should always seek out a specialist for the most accurate diagnosis and to prevent false diagnosis, which could lead to unneeded treatment and spread of cancer.

A physical exam and blood sample can help identify mesothelioma signs. These tests can be used to look for asbestos fibers in blood or to assess the health of a patient's internal organs. The most precise method of diagnosing mesothelioma involves taking a biopsy. Doctors remove tissue or fluids from the affected area and then examine them under a microscope for mesothelioma cancerous cells.

The type of mesothelioma a person is suffering from also affects the likelihood of a positive outcome. Pleural mesothelioma that develops in the thin lining around the lungs, is the frequent form of the disease and accounts for the majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that is found in the abdomen's lining, is less common. Finally, pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is much less common and represents approximately 1% of cases.

The first signs include breathlessness that becomes worse over time and coughing up blood. Asbestos patients may also experience fluid accumulation in the chest cavity. This is known as Pleural effusion. The fluid can be drained from the chest cavity by inserting an needle into the area affected. In more severe cases, doctors might perform pleurodesis. This is an operation which seals the area in order to prevent fluid from accumulating again within the pleura.

Making sure that mesothelioma is diagnosed correctly is the most reliable way to determine the patient's treatment options as well as their survival rate. There are many treatments available, including surgery, chemotherapy and radiation. There are also immunotherapy treatments that enhances the immune system to fight mesothelioma and cancer treating fields that employ magnetic fields to kill cancerous cell.

A mesothelioma specialist can assist patients in understanding various mesothelioma cell types, which determine the extent of the cancer as well as the outlook of the patient. Patients should discuss with their doctor their experiences with asbestos exposure to determine whether mesothelioma is a possibility and what treatment options are available.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos was used in many industrial and consumer products, including baby powder. Plaintiffs in talcum powder lawsuits claim that inhaling talcum powder contributed to asbestos exposure, which contributed to mesothelioma and various other health issues.

J&J allegedly knew about the dangers of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. The claims have been amalgamated into federal and state multidistrict litigations, or MDLs.

In 2018, one of the largest trial involving talc resulted in a $4.7 billion settlement for the plaintiff. This was a major news story and set the stage for the rest of the year. Last month, a judge denied a motion by J&J to dismiss the lawsuits filed by the state of Mississippi.

However, in an attempt to stop the litigation, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company created an entity that would take on its obligations. The bankruptcy was able to halt the talc lawsuits of thousands, but the 3rd Circuit rejected this strategy.

The lawsuits brought by Mississippi are based on the same allegations of the individual lawsuits filed against J&J. They claim that the company acted negligently in failing to warn consumers of the possibility of ovarian carcinoma from talcum-powder and that this was a violation of state law.

J&J has filed a motion to dismiss lawsuits before a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J are able to be pursued. If you or someone you know has been diagnosed with a mesothelioma or another condition which could be caused by talcum powder you should seek legal assistance immediately. Our experienced attorneys can assist you in obtaining the compensation that you deserve.
