Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with pericardial mesothelioma has alleged Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma trial is one of the first one to be held since J&J separated its talc business and filed for bankruptcy.
In the spring of this year, jury awards in New Jersey and California led to big settlements in talc-related lawsuits. Plaintiffs linked their cancer to asbestos in J&J's Shower Shower and Baby Powder products.
What is Mesothelioma?
Mesothelioma, a deadly type of cancer is a disease of the mesothelium the lining surrounding organs and cavities in the body. It is most often found in the lungs, however it can also occur in the abdomen, heart and chest cavity, as well as the testicles. Asbestos, the sole known cause of this disease, is asbestos. People who have been exposed to asbestos are at a higher chance of developing it.
The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional as they heard the story of the plaintiff. In 2022, the plaintiff who was just 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma in the pericardium. The plaintiff attributed his condition to childhood exposure to Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J has been accused of obfuscating asbestos risks from consumers for a number of years. J&J has a history of withholding asbestos findings from regulators and funding asbestos tests to get the results it wanted. These lawsuits have identified several of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.
Many women who used talcum powder to maintain feminine hygiene in the genital region or on sanitary napkins or condoms have been diagnosed with cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits assert that J&J knew for more than 40 years that using the powder could cause mesothelioma and ovarian cancer however, they failed to warn consumers of the danger.
Mesothelioma symptoms include breathing difficulties, constant coughing and abdominal pain, fatigue, and lumps or masses on the abdomen or chest. Doctors can detect mesothelioma with physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.
When mesothelioma is discovered patients may undergo surgery, chemotherapy or radiotherapy. Depending on the location of their tumors surgeons may be able to remove the affected tissue. Certain patients with mesothelioma have a lifespan less than five. However aggressive treatments like extracorporeal tissue transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong the life of patients.
What causes Mesothelioma?
Mesothelioma, as with most cancers, is caused by DNA mutations within a cell. These mutations lead to uncontrolled cell growth that creates tumors in the tissues. Asbestos is the most common mesothelioma cause. Asbestos exposure is common in a variety of industries, including manufacturing, mining and transportation. Asbestos is usually exposed for between 20 and 40 years prior to symptoms appearing. Mesothelioma is more common in males than women, and is most commonly diagnosed in those in their 50s and 70s. The type of mesothelioma a sufferer is usually determined by the part of their body where they were exposed to asbestos. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma, which affects the lungs. Some are diagnosed with peritoneal msothelioma. This kind of mesothelioma affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is a rare type of cancer that affects both the lining (pericardium) as well as the organ itself.
Symptoms of mesothelioma include fatigue, breathlessness abdominal pain and weight loss. In the late stages of mesothelioma tumors can spread to other areas of the body, creating severe discomfort and pain. Other symptoms of mesothelioma include fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma is a debilitating illness that is usually fatal.
The talcum-powder case in Oakland involved an individual of 24 years old who developed pericardial msothelioma following the use of J&J baby powder. His lawyers argued that J&J knew talc could contain asbestos and didn't warn consumers. They also cited a letter from 1998 to a J&J executive that revealed the possibility of asbestos in their products.
This is the latest in a string of high-dollar verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in one woman. In March, a jury in Missouri awarded $55 Million in the same case. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the total number of pending suits. Most of these lawsuits are filed by women who used J&J talcum powder to maintain their feminine hygiene.
How Can I tell whether I have mesothelioma or not?
A diagnosis of mesothelioma can be devastating. Patients must always consult a doctor to get the most precise diagnosis and to avoid mistakes that could result in unnecessary treatment and the spread of cancer.
A physical examination and a blood sample can help to identify mesothelioma symptoms. These tests can be used to check for asbestos fibers in blood, or the health of the patient's internal organs. The most precise method of diagnosing mesothelioma is taking a biopsy. Doctors take tissue or fluids from the affected area, and examine them under a microscope to look for mesothelioma cancerous cells.
The type of mesothelioma that is present in a patient can influence the prognosis of a patient. Pleural mesothelioma, which forms in the thin lining that surrounds the lungs, is the most common form of mesothelioma and makes up the majority of diagnosed cases. Peritoneal mesothelioma, a cancer that forms in the lining of the abdomen is less prevalent. Finally, pericardial mesothelioma, an uncommon type that develops in the heart's lining is much rarer and only makes up about 1% of cases.
The breath is short, and is more severe with time, and a bloody cough are among the first symptoms. Asbestos sufferers might also experience fluid buildup in the chest cavity, a condition called pleural effusion. The fluid can be drained from the chest cavity by inserting an needle into the affected area. In more severe cases, doctors may perform a procedure called pleurodesis to seal the space to stop the reaccumulation of fluid in the pleura.
A precise diagnosis of mesothelioma is crucial to determine a patient's survival rate and treatment options. There are a variety of treatments available, including surgery, chemotherapy and radiation. Other options include immunotherapy, which is a type of treatment that boosts the immune system to fight mesothelioma cancer cells, and tumor treating fields, which uses an electromagnetic field to kill cancerous cells.
A mesothelioma specialist who is specialized can also help patients understand the different mesothelioma cell types which determine how invasive the cancer is and what the patient's prognosis is. Patients should discuss their experience of asbestos exposure with their doctor to determine if they're mesothelioma candidates and find out what types of treatment might be available to them.

Mesothelioma is a rare, but fatal illness that is caused by asbestos exposure. Asbestos used to be widely used in many industrial and consumer products like baby powder. In talcum powder cases, plaintiffs claim that exposure to asbestos from inhaling the powder led to the development of mesothelioma, or other health issues.
J&J believed to have known about the risk of asbestos and talcum powder for decades, but did not warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. The claims have been amalgamated into federal and state multidistrict litigations, or MDLs.
In Folsom mesothelioma lawyer of the first large talc trials resulted in a $4.7 billion settlement for the plaintiff. The news made headlines across the country and set the tone for the rest of the litigation. Last month, a court denied J&J's request to dismiss the lawsuits filed by the state.
J&J, however, tried to stop the litigation. The company set up a new subsidiary entity to take on its talc liability, and LTL Management filed for bankruptcy. The bankruptcy was able to halt the talc lawsuits of thousands, but the 3rd Circuit rejected this strategy.
The lawsuits filed by Mississippi are based upon the same allegations as those of the individual lawsuits brought against J&J. They assert that the company acted negligently in not warning of the possibility of ovarian cancer from talcum-powder and that this was an infraction to the law of the state.
