Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is to blame for his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J separated its Talc business and filed for bankruptcy.
In the first quarter of the year, substantial settlements were reached in talc suits in New Jersey and California. Plaintiffs linked their cancer to asbestos found in J&J's Shower Shower and Baby Powder products.
What is Mesothelioma?
Mesothelioma is a deadly type of cancer that affects the mesothelium the lining around organs and body cavities. It is most often found in the lungs but it can also occur in the abdomen, heart and chest cavity as well as testicles. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed to asbestos are at an increased risk of developing it.
The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional as they listened to the plaintiff's story. In 2022, the plaintiff, who was only 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma of the pericardium. He attributed his illness to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J is accused of hiding asbestos-related risks from consumers for decades. J&J has a history of hiding asbestos-related findings from regulators and even funding asbestos tests to get the results it desired. These lawsuits have identified several of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and others.
Many women who used talcum powder for feminine hygiene in the genital areas or on sanitary napkins or condoms have been diagnosed with cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits assert that J&J was aware for more than 40 years that the powder could trigger ovarian cancer and other illnesses, but did not take the time to warn consumers.
Mesothelioma symptoms can include breathing difficulties, constant coughing fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can diagnose the disease through a physical examination and imaging scans. These may include CT (computer tomography) scans, MRIs and PET or X-rays.
Once a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the site of their tumors, surgeons might be able to remove the affected tissue. Certain patients with mesothelioma have a life expectancy less than five. However aggressive treatments like extracorporeal tissue transplantation or the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the life of patients.
What causes Mesothelioma?
Like all cancers, mesothelioma is caused when a cell's DNA experiences mutations. These mutations cause cells to multiply in uncontrolled ways and form tumors in the tissues of the body. Asbestos is the most common cause mesothelioma. Exposure to asbestos can occur at work in many different industries such as manufacturing, mining construction, and transportation. Asbestos can be exposed for between 20 and 40 years prior to the onset of symptoms appearing. Mesothelioma is more prevalent in men than women, and is most often diagnosed in people who are in their 50s to 70s. The kind of mesothelioma involving asbestos that someone develops is often determined by the place on their body they were exposed. Most mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Others are diagnosed with peritoneal mesothelioma, one type of mesothelioma which affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is an extremely rare form of cancer that affects both the liner (pericardium) and the organ itself.
Insomnia, fatigue, and abdominal pain are all symptoms of mesothelioma. In the last stages of mesothelioma the tumors can grow to other areas, causing severe discomfort and pain. Other symptoms that are common to mesothelioma are fluid on the lung (pleural effusion) loss of appetite, difficulty swallowing and a blockage in the small intestine called a obstruction of the bowel. Mesothelioma is a terminal illness, and it can be fatal.
The trial involving talcum powder in Oakland involved a 24-year-old man who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos, but did not warn consumers. They also cited a letter in 1998 to an J&J executive which revealed asbestos could be present in their products.
This is the latest in a series of major verdicts against J&J. In March, J&J's Talcum powder caused ovarian mesothelioma in one woman. Last month, another jury in Missouri awarded $55 Million in a similar case. In addition, seven cases were added to the powder talcum MDL in the last month and brought the number of lawsuits pending to 37,522. The majority of these lawsuits involve women who used J&J's Talcum powder for feminine hygiene reasons.
How can I tell whether I have mesothelioma not?
A diagnosis of mesothelioma could be devastating. Patients should consult an expert to obtain the most accurate information available and avoid misdiagnosis that could lead to unneeded treatment or allow cancer to spread more.
A physical examination and blood test can be an effective way to determine whether mesothelioma has caused symptoms. These tests can detect asbestos fibers in blood or to determine the extent to which a patient's organs are functioning. The most accurate method of diagnosing mesothelioma is a biopsy. Doctors extract tissues or fluids from the affected area, and examine them under a microscope to look for mesothelioma cancer cells.
The type of mesothelioma that a person is suffering from also affects the prognosis of their patient. Pleural mesothelioma, which forms in the thin lining around the lungs, is the frequent form of the disease and accounts for the majority of diagnosed cases. Peritoneal mesothelioma, which is a cancer that is found in the abdomen's lining is less prevalent. In addition, pericardial mesothelioma which is a rare type of cancer that develops in the lining of the heart, is much less common and represents about one percent of cases.
A shortness of breath that gets worse with time, and a bloody cough are some of the first symptoms. Asbestos victims might also experience fluid buildup in the chest cavity, a condition known as pleural effusion. The fluid can be removed from the chest cavity by inserting an needle into the area affected. In more severe cases, doctors may use a procedure known as pleurodesis, which seals the area to stop the reaccumulation of fluid in the pleura.
A precise diagnosis of mesothelioma is crucial in determining the rate of survival for a patient and treatment options. There are many treatments available that include surgery, chemotherapy and radiation. Other options include immunotherapy, a kind of treatment that increases the immune system to fight mesothelioma cells and tumor-removing fields, which employ an electromagnetic field to eliminate cancerous cells.
A specialized mesothelioma specialist can also assist patients in understanding the different mesothelioma cells, which determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their physician their experiences with asbestos exposure to determine whether mesothelioma is a possibility and what treatment options are available.

Nashville mesothelioma attorney is a rare, but fatal disease that is caused by asbestos exposure. Asbestos was a time when it was widely used in a wide range of consumer and industrial products including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder contributed to their asbestos exposure, which contributed to mesothelioma and other health problems.
J&J allegedly knew about the dangers of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. The claims have been combined in state and federal multidistrict lawsuits, or MDLs.
In 2018 one of the largest talc trials resulted in a $4.7 billion settlement for the plaintiff. This was a national news story that set the tone for the rest of the year. In the last month, a judge denied J&J's motion to dismiss the lawsuits filed by the state.
In an attempt to derail the litigation, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company created an entity to take over its liabilities. The bankruptcy stopped hundreds of talc suits but the 3rd Circuit rejected that strategy.
The lawsuits brought by Mississippi are based upon the same allegations that are in the background of the individual lawsuits filed against J&J. They allege that the company was negligent in failing to warn consumers of the possibility of ovarian cancer due to talcum-powder, and that this resulted in an infraction of the law of the state.
J&J has submitted its motion to dismiss lawsuits to a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to be pursued. If you or someone near you has been diagnosed with mesothelioma or another condition which could have been caused talcum powder. You must seek legal advice immediately. Our experienced lawyers can help you receive the compensation you deserve.
