Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A 24-year-old man with pericardial mesothelioma has alleged Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J has dissolved its Talc business and filed for bankruptcy.
In the early part of this year, large settlements were reached in talc suits in New Jersey and California. Plaintiffs have linked cancer to asbestos found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a fatal form of cancer that affects the mesothelium the lining around organs and body cavities. It is most common in the lungs but can also be located in the abdomen and chest cavity. Asbestos, the sole known cause of this disease is asbestos. People who have been exposed to asbestos are at chance of developing it.
The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional when they heard the plaintiff's story. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He blamed his condition on childhood exposure to Johnson & Johnson baby powder. The jury awarded him $26 million.
J&J is accused of hiding asbestos risks from consumers for several decades. The company has a long history of concealing asbestos-related information from regulators, and even paying for asbestos tests that gave the results they wanted. Several of the company's talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.
Some women who used talcum for feminine hygiene on sanitary pads or condoms or in the genital area have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than 40 years that the powder could cause ovarian cancer as well as other illnesses, but failed to warn consumers.
Mesothelioma symptoms can include breathing problems, chronic coughing and fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can detect mesothelioma with physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.
When mesothelioma is discovered, patients can undergo chemotherapy, surgery, or radiotherapy. Depending on the location of their tumors surgeons may be able to remove the affected tissue. Patients with mesothelioma can be given a life expectancy less than five years. However, aggressive treatments like extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy can prolong the life expectancy.
What is the cause of Mesothelioma?
Like many cancers, mesothelioma develops by DNA mutations. These mutations cause uncontrolled cell growth, which creates tumors in the tissues. Asbestos is a frequent cause of mesothelioma. Asbestos exposure can be found in a variety of industries such as manufacturing, mining, and transportation. Asbestos is usually exposed for 20 to 40 years before symptoms developing. Mesothelioma affects men more than women, and it is most often diagnosed in people who are in their 50s to 70s. The kind of mesothelioma involving asbestos that someone develops is often determined by the place on their body they were exposed. Most people with mesothelioma are diagnosed with pleural mesothelioma, which affects the lung. Some are diagnosed with peritoneal mesothelioma, which is a mesothelioma type that affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is an extremely rare form of disease that affects both the lining (pericardium), and the organ itself.
Insomnia as well as abdominal pain and fatigue are all signs of mesothelioma. In the later stages of mesothelioma tumors can spread to other areas of the body, causing extreme pain and discomfort. Other signs of mesothelioma are fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma is a fatal disease, and can be fatal.
The trial involving talcum powder in Oakland involved a man aged 24 who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos but did not inform customers. They also cited a letter from 1998 to a J&J executive that revealed the possibility of asbestos in their products.
This is only the latest in a long line of high-dollar verdicts against J&J. In March the jury awarded $18.8 million to a woman who developed mesothelioma ovarian from J&J's talcum powder, and last month, a jury in Missouri awarded $55 million in another case that involved the same issue. Seven new cases have been added to the MDL talcum-powder in the last month, bringing it to 37,522 the total number of lawsuits in the process. The majority of these lawsuits concern women who used J&J's talcum powder to wash their feminine hygiene.
How do I know if I have mesothelioma or not?
A diagnosis of mesothelioma is devastating. Patients should always see an expert to obtain the most accurate diagnosis possible and avoid misdiagnosis which could lead to unnecessary treatment and let cancer spread more.
A physical examination and blood test is an excellent way to determine whether mesothelioma may be causing symptoms. These tests can detect asbestos fibers in the blood or to determine how well a patient's organs are functioning. The most precise method to identify mesothelioma is with a biopsy, where doctors remove fluid or tissue from the affected area and examine the area under a microscope to search for mesothelioma cancer cells.
The type of mesothelioma that sufferers have can influence their prognosis. Pleural mesothelioma is by far the most commonly encountered type of disease and accounts for the majority of cases that are diagnosed. You Tube , which develops in the lining surrounding the abdomen, is a less common type. Lastly, pericardial msothelioma is a rare kind that is found in the lining of the heart. It's only 1% of all cases.
Some of the first symptoms include breathlessness that becomes worse over time and a coughing up of blood. Asbestos sufferers can also experience fluid accumulation in the chest cavity, a condition known as pleural effusion. It can be eliminated by inserting a needle into the affected region of the chest cavity. In more serious cases, doctors can undergo a procedure called pleurodesis to seal the space to prevent the reaccumulation in the pleura.
A precise mesothelioma diagnosis is the best way to determine the patient's treatment options and survival rate. There are a variety of treatments available that include surgery, chemotherapy and radiation. Other options include immunotherapy which enhances the immune system to fight mesothelioma as well as tumor treating fields that use a magnetic field in order to kill cancerous cells.
A mesothelioma specialist may also assist patients in understanding various mesothelioma cell types, which determine the extent of the cancer as well as the outlook for patients. Patients should discuss their history of asbestos exposure with their doctor to determine if they're mesothelioma candidates and discover what kinds of treatment are available to them.

Mesothelioma is a rare, but fatal disease that is caused by exposure to asbestos. Asbestos was a time when it was widely used in a range of industrial and consumer products including baby powder. In talcum powder cases plaintiffs assert that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma, or other health issues.
J&J allegedly knew about the dangers of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against the company seeking damages for punitive and compensatory. The claims have been combined in state and federal multidistrict lawsuits, also known as MDLs.
In 2018 one of the biggest Talc cases resulted in a $4.7 billion verdict in the favor of the plaintiff. This was a major news story that set the tone for the rest of the year. Last month, a court denied J&J's request to dismiss the lawsuits filed by the state.
J&J however, attempted again to halt the litigation. LTL Management, a subsidiary of J&J, filed for bankruptcy after the company incorporated an entity to take over its obligations. The bankruptcy was able to halt thousands of talc lawsuits but the 3rd Circuit rejected this strategy.
The lawsuits brought by Mississippi are based upon the same allegations that are in the background of the individual lawsuits brought against J&J. They claim that the company acted negligently in failing to warn of the risk of ovarian carcinoma due to talcum-powder, and that this constituted a violation of state law.
J&J has submitted its motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine if the lawsuits against J&J will be allowed to be pursued. If you or someone near you has been diagnosed with mesothelioma or another condition which could have been caused by talcum powder. You must seek legal advice immediately. Our skilled lawyers will assist you in getting the compensation you deserve.
