Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with pericardial msothelioma claims that Johnson & Johnson baby powder is to blame for his cancer. The Oakland mesothelioma trial is the first one to be held since J&J separated its Talc business and filed for bankruptcy.
In the beginning of the year, substantial settlements were made in talc suits in New Jersey and California. Plaintiffs linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects mesothelium the lining that surrounds organs and body cavities. It is most common in the lungs, but it can also be found in the chest and abdomen cavity. Asbestos, the sole known cause of this disease is asbestos. People who have been exposed to asbestos are at chance of developing it.
The first trial since J&J declared bankruptcy on its talcum-powder division began in Oakland, California this week. Jurors were impressed by the story of the plaintiff. In 2022, the plaintiff who was only 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma of pericardium. The plaintiff attributed his condition to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J has been accused of concealing asbestos risks from consumers for a long time. The company has a long history of hiding asbestos-related findings from regulators, and even supplying asbestos tests to generate the results it wanted. Several of the company's talcum powder suppliers have been named in these lawsuits and include Whittaker, Clark & Daniels and Imerys Talc America.
Many women who used talcum powder for feminine hygiene in the genital area or on sanitary napkins or condoms have gotten ovarian cancer, and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could cause ovarian cancer as well as other illnesses, but failed to warn consumers.
Mesothelioma symptoms include difficulty breathing, persistent coughing fatigue, abdominal pain and lumps or masses on the abdomen or chest. Doctors can identify the disease by a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.
When a mesothelioma diagnosis is confirmed, patients can undergo chemotherapy, surgery, or radiation. The surgeons are able to remove the affected tissue based on the location of the tumors. Some patients with mesothelioma have a lifespan less than five. However aggressive treatments like extracorporeal tissue transplantation or cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong the life of patients.
What is YouTube of Mesothelioma?
Mesothelioma, like most cancers is caused by DNA mutations within a cell. These mutations cause the cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is a frequent cause of mesothelioma. Exposure to asbestos can be found in a variety of industries such as manufacturing, mining, construction and transportation. Asbestos can be exposed for 20 to 40 years prior to symptoms developing. Men are more likely to develop mesothelioma than females. It is also diagnosed most often in people between the ages of 50 and 70. The kind of mesothelioma caused by asbestos that a person develops is usually determined by the place they were exposed. Most people with mesothelioma are diagnosed with pleural mesothelioma which affects the lung. Others are diagnosed as having peritoneal msothelioma. This type of mesothelioma affects the abdomen. Finally, some people are diagnosed with pericardial mesothelioma. It is an extremely rare type of the disease that affects the lining of the heart (pericardium) and the organ itself.
Shortness of breath, fatigue and abdominal pain are all symptoms of mesothelioma. In the last stages of mesothelioma the tumors can spread to other parts which can cause extreme discomfort and discomfort. Other symptoms that are common to mesothelioma include fluid on the lungs (pleural effusion), loss of appetite, difficulty swallowing and a blockage within the small intestine referred to as a obstruction of the bowel. Mesothelioma can be fatal.
The trial involving talcum powder in Oakland involved a man of 24 who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers argued that J&J knew that talc was contaminated with asbestos, but did not warn consumers. They also cited an 1998 letter to a J&J executive revealing the possibility of asbestos in their products.
This is only the latest in a series of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. In March, a jury in Missouri awarded $55 million in an identical case. Seven new cases have been added to the MDL talcum-powder over the past month, bringing to 37,522 the total number of lawsuits pending. The majority of these lawsuits involve women who have used J&J's talcum powder for feminine hygiene reasons.
How do I know if I Have Mesothelioma?
A diagnosis of mesothelioma may be devastating. Patients should always see a specialist to get the most accurate diagnosis possible and prevent misdiagnosis that could lead to unnecessary treatment or allow cancer to grow.
A physical examination and blood test can be an effective way to determine whether mesothelioma may be causing symptoms. These tests can detect asbestos fibers in blood or to determine how well a patient's organs are functioning. The most accurate way to identify mesothelioma is with a biopsy, where doctors remove fluid or tissue from the affected area and examine it under a microscope in order to look for mesothelioma cells.
The type of mesothelioma is present in a patient can affect his or her prognosis. Pleural mesothelioma, that forms in the thin lining around the lungs, is the common form of the disease and accounts for the vast majority of diagnosed cases. Peritoneal mesothelioma, a cancer that forms in the abdomen's lining, is less common. In addition, pericardial mesothelioma which is a rare type of cancer that develops in the heart's lining, is much less common and represents about one percent of cases.
A shortness of breath that is more severe with time, and bloody coughing are some of the first symptoms. Asbestos patients may also experience fluid buildup in the chest cavity, a condition known as pleural effusion. This can be drained by inserting a needle in the affected area of the chest cavity. In more serious cases, doctors may opt to perform pleurodesis, which is a procedure that seals the cavity in order to prevent the fluid from accumulating within the pleura.
A precise mesothelioma diagnosis is the best method to determine a patient's treatment options as well as their survival rate. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy. It is a type of treatment that boosts the immune system to fight mesothelioma cells and tumor-targeting fields, which uses an electromagnetic field to destroy cancerous cells.
A mesothelioma specialist who is specialized can also help patients understand the various mesothelioma types that determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their doctor their experiences with asbestos exposure to determine whether mesothelioma is possible and what treatment options are available.

Mesothelioma is a rare, but fatal disease caused by asbestos exposure. Asbestos was a time when it was widely used in a wide range of industrial and consumer products, including baby powder. Plaintiffs in talcum powder lawsuits claim that inhaling talcum powder caused to their exposure to asbestos and subsequently mesothelioma as well as other health issues.
J&J did not inform the public about the dangers of asbestos and talcum even though they were aware of them for decades. Plaintiffs have filed mesothelioma lawsuits against the firm seeking compensatory and punitive damages. These lawsuits have been combined into federal and state multidistrict litigations or MDLs.
In 2018 one of the biggest talc cases resulted in an $4.7 billion verdict in favor of the plaintiff. This made national headlines and set the tone for the rest of the litigation. Last month, a judge ruled against a request by J&J to dismiss the lawsuits filed by the state of Mississippi.
However, in an effort to derail the litigation, J&J tried again. LTL Management, a subsidiary of J&J, filed for bankruptcy after the company created a new entity to assume its obligations. The bankruptcy ended the filing of thousands of talc lawsuits, but the 3rd Circuit rejected that strategy.
The lawsuits filed by Mississippi are based upon the same allegations that are in the background of the individual lawsuits brought against J&J. They claim that the company was negligent in not warning of the risk of ovarian carcinoma from talcum powder and that this was an infraction to the law of the state.
J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J are able to proceed. If you or someone you love is diagnosed with mesothelioma, or any other condition which could be caused by talcum powder you should seek legal representation immediately.
