تلخيصًا الموقف يقول " القاعدة صحيحة والتغيرات حسب الاحوال " والفارق بينها وبين الموقف التقليدي أن القاعدة مو ملزمة بنحو مطلق,إنما الاجتهاد بحدود النص لأن النص كنص مستقل عن الزمان والمكان.
-يعني الموقف يعتبر الشريعة مستمدة من مبادئ عامة,ولو نظرنا وش يعني هالكلام,بما أنها مرتبطة بالأحوال أي ان المبدأ العام لايمكن يكون مستنبط رأسًا منها,لأن الانتقال من مبدأ عام للقاعدة يتطلب عملية انسانية
يعني اذًا هنا نخرج عن النص ونقول أن القواعد العامة تتكون من
1-صحتها
2-الوضع الانساني:كون الانساني اجتماعي والظروف الاجتماعية المتغيرة
والوضع الانساني له ثابتين
1-نوع مرتبطة صحته بالمبادئ العامة وثوابته وقواعده الاخلاقية
2-ونوع يستمدها من كون في متغيرات للوضع الاجتماعي (الزواج الارث..الخ)
وكون الشخص يعترف هالتمييز,لانه قسم احكام الشريعة لمتغيرات وثوابت مثل العقيدة,اذًا الاحكام العامة أكيد هي من النوع الثاني للوضع الانساني,اي المتغيرة
وبما انها من النوع الثاني فـ علتها بالطبع من خارجها وليست مستنبطة منها نصًا..يعني لو كان الحكم العام هو "تحقيق منفعة الناس العامة" وتحقيقها متعلقة بالظرف الثقافي والاجتماعي
فالنص ماعاد يضمن ان مع التغييرات يقدر يحقق لك المصلحة العامة..اذًا ما تقدر تقر ان في مبدأ عام,بس تدور حول النص لان عملية هالانتقال هي عملية استنباطية خارج النص
وقد تصل لرفع النص رفع كامل اذا اقريت المبدأ العام,اي الاستغناء عن النص
لذلك لا مفر الا أنك تتخذ موقف يقول أن مبدأ النص ذو قيمة بذاته لا خارجه عنه ولا هي وسيلة لأمر ما..وهنا نرجع لموقف تقليدي له تعليق خاص عنه
