C&SN's work with the Global NPO Coalition on FATF

To protect the nonprofit sector from terrorism financing and money laundering, the United Nations' Financial Action Task Force (FATF) sets standards and recommends changes to anti-money laundering and counter-terrorist financing legislation. The standards and recommendations have been used as the basis for assessing the adequacy of laws in nearly every country. The terrorist attacks in 2001 and other global events have prompted a greater focus on regulation of charitable organizations and financial services. The FATF has made progress in addressing abuses of this program by establishing Recommendation 8 on laws pertaining to nonprofit organizations.

The Global NPO Coalition has provided a valuable platform for civil society to raise its voice in FATF meetings. The coalition has compiled and coordinated responses to draft revisions of FATF documents. They have also helped develop a formal consultation process with FATF and worked to change the R8 Interpretive Note. The Coalition has also authored several reports and policy briefs on international trade and investment and FATF.

According to C&SN's research on financial access for NPOs, nearly one-third of nonprofits carry cash to meet their daily needs. Carrying cash is fraught with risks, including liability and physical risks to NPO staff. Even though many nonprofits would prefer not to carry cash, this practice can cause problems. In one case, the director said that carrying cash was the only option available.

Financial access is a necessity for nonprofit organizations to conduct international financial transactions. However, many organizations have difficulty conducting international financial transactions because financial institutions often slow down or refuse transfers. Some institutions turn nonprofits away, shutting down their accounts. This can also be problematic for remittance services that help diaspora populations transfer funds. In a February 2017 report, C&SN identified the systemic problem and recommended urgent government action.

C&SN's involvement in the Holder v. Humanitarian Law Project

On January 19, the Supreme Court issued a ruling in the case of Holder v. Humanitarian Law Project. This case centers around a legal theory that a government should not be able to discriminate based on a group's political beliefs or ideology. In this case, the Humanitarian Law Project sought to provide training to the PKK, which is a group that advocates for the rights of Kurds living in Turkey. In the case, the Humanitarian Law Project sought to provide assistance to the PKK to facilitate the peaceful resolution of disputes, and to monitor human rights in the Kurdish areas of Turkey.

The case was filed in November 2005 and assigned to Judge Collins, who ruled in favor of the Humanitarian Law Project. The case was argued before judges of the Southern District of New York and the Ninth Circuit on November 19, 2008. The decision of the court was unanimous except for dissenting Judge Pregerson, which was joined by Justice Alito. The company has certified 10 of its facilities as AWS-certified facilities.

The company has announced plans to invest up to $2 billion in clean technologies to increase its use of recycled plastic. In addition, Nestle plans to cut its use of new plastic by 50% by 2025. But there's more good news for consumers. Nestle has recently announced a $260 million venture fund to invest in start-ups that focus on sustainable packaging. In total, these efforts could lead to a 2 billion Swiss franc investment. But critics say Nestle is one of the world's worst corporate polluters of plastic.
