Panel discussion on counterterrorism law
This panel discussion on counterterrorism law will feature leading international and regional experts and enlightened citizens. This event is co-sponsored by the International Peace Institute and the UN Counterterrorism Implementation Task Force. The panelists are seasoned attorneys with diverse backgrounds, and each will discuss the importance of clear, comprehensive laws regarding the dissemination of intelligence and the policing of counterterrorism efforts.
The book offers a compendium of Strasbourg Court caselaw as well as a detailed analysis of the applicable principles. This book can be useful to legal officers, policy makers, human rights experts, and victims. It is a concise, useful guide in a complex and sensitive area of counter-terrorism and human rights. However, it can't be used to justify excessively harsh counter-terrorism laws.
Submission of comments to FATF
While it is important to consider the risk of terrorist financing when drafting rules and guidelines, the participation of NPOs is not always obvious. For example, certain financial institutions have restricted their access to NPOs or taken longer to process transactions for these organizations. This wholesale termination of NPOs' customers does not conform to the risk-based approach and FATF standards. Experts who work with NPOs on AML/CTF issues should provide comments to FATF requesting the organisation to acknowledge the categories mentioned in this paper.
Governments have been passing laws that restrict the activities of NPOs in the name of counterterrorism. While these laws may mention Recommendation 8 and compliance with global regulatory standards, these measures are in violation of binding international human rights obligations. Further, governments should refrain from targeting NPOs for their pure speech, as a broad interpretation of "extremism" may politicize the process. To address these issues, governments should consider the submission of comments by NPO experts to the FATF.
