Bernhard Burgener is suing David Degen in the FC Basel ownership dispute. Burgener's plans are backed by the Board of Directors. However, there's no agreement.
Bernhard Burgener Monday morning saw the day of FC Basel Holding AG's board directors. The majority of the committee of four comprising Burgener and Degen and Karl Odermatt and Peter von Buren agreed with the plan of the former owner. He asked Degen to sell his stake to the potential buyer, Basel Dream & Vision AG, according to an official statement from the holding company.
The shares of Burgener can be sold to shareholders of minor value by the Board of Directors under the provisions of a contractually formulated law. According to the Board of Directors, this drag-along rights is preeminent over Degen's pre-sale rights.
Bernhard Burgener Burgener together with his team, have made moves in the dispute between owners. Degen insists on exercising his right to first refusal which he wants to exercise in exchange for 16.4 million francs. Burgener's stake of 80% in Basel Dream & Vision AG is being stopped by a super-provisional restraining order. Bernhard Burgener Centricus the British asset manager, will also have a stake in the new company. Bernhard Burgener Burgener will still get the majority votes.
