The Meeting of NPO Experts on FATF Recommendation 8
In January 2018, a group of NPO experts met in Vienna to review the implementation of FATF Recommendation 8 in their respective countries and to identify new challenges. The group comprised experts from 29 countries, and engaged with the FATF Secretariat and select government representatives in Vienna on these matters. Here, we will review the main highlights from their meeting, as well as their contributions and recommendations for implementation. Further, we will explore how to better engage NPO experts in your own country to improve the quality of policy-making, which will help drive change.

NPOs cannot be political

Recommendation 8

Recommendations addressing the financial sector are becoming a global norm and the FATF has formulated Recommendation 8 for NPOs to ensure that their regulatory frameworks are in line with these standards. This Recommendation highlights the importance of identifying appropriate points of contact, establishing procedures to address international requests and providing adequate resources to the NPO sector. In this Recommendation, "appropriate authorities" refers to relevant competent authorities, such as government bodies and accrediting institutions. Lastly, the sector must identify its beneficiaries (i.e. natural persons) and carry out a risk assessment of its activities.

Recommendation 8 is primarily a TF recommendation. It stipulates that countries undertake a risk assessment of NPOs' exposures to terrorist financing and adopt measures commensurate to the risks identified. Although the FATF has not specified a particular format for risk assessments, countries are encouraged to develop and use a combination of these approaches. In the latter case, they may conduct a separate, stand-alone NPO sector risk assessment, or incorporate it into a national terrorist-financing risk assessment.

Financial inclusion of charitable entities

The Global NPO Coalition on FATF (Global Alliance of Nonprofit Organizations on Financial Inclusion) was invited to lead a session at the 2018 FATF meeting on financial inclusion for charitable entities. GAFILAT is the regional body for Latin America under the FATF and organized the regional workshop in Havana, Cuba in March. The Global NPO Coalition shared its Declaration at the meeting, which was facilitated by GAFILAT.

The nonprofit sector has cleared the way for private institutions to offer financial services to the poor on a profit. The question then is: how can nonprofits continue to promote financial inclusion? They could shift their focus to other fields, which would leave market failures in place. Financial inclusion is an issue of societal trust and innovation. Charitable entities need subsidies to maintain the status quo, however. If they do so, they could be left with little choice but to cut back on services and focus on other areas.
