Bernhard Burgener is suing David Degen in the FC Basel ownership dispute. Burgener's plan is supported by the Board of Directors. But, http://y8space.com/members-2/bernhard-burgenerodyy456/activity/3990948/ 's not possible to come to an agreement.
Monday morning saw the meeting of FC Basel Holding AG's Board Directors. Burgener, Degen, Karl Odermatt and Peter von Buren voted in favor of the previous owner's plans. In a report by the holding company that he was a part of, he asked Degen to let him sell his stake in Basel Dream & Vision AG.
To do this, the Board of Directors relies on the terms of a contract that allows Burgener to sell its own shares to the shareholders of minority shareholders on the same conditions. The Board of Directors says that the right to presale of Degen is overridden by the dragalong right.
Burgener and his team have made an appearance in the dispute between the owners. Degen is insisting on his first refusal. He wants to use this right for 16.4 Million Francs. Burgener is unable to sell his 80 percent stake to Basel Dream & Vision AG due to a superprovisional injunction. Centricus, a British asset management company will also have a stake. Burgener still would get the majority vote.
According to the announcement by FC Basel Holding AG, Burgener and Degen are quickly seeking an out-of-court settlement "in the interest of FCB".
