Bernhard Burgener, David Degen and their dispute regarding FC Basel's owner's name is just the beginning of their dispute. The Board of Directors supports Burgener's plans. But there hasn't been any agreement reached.
Monday morning saw the meeting of FC Basel Holding AG's Board of Directors. Bernhard Burgener Burgener, Degen, Karl Odermatt and Peter von Buren voted in favor of the original owner's plans. According to the statement of the holding company, the owner demanded Degen if he would sell his stake to Basel Dream & Vision AG.
Burgener is able to sell its own shares under the same terms to minor shareholders in accordance with a contractually negotiated law. As per the Board of Directors this so-called drag along right is in contrast to Degen's presale right.
Burgener and his group have made an announcement in the ongoing dispute between the owners. Degen is seeking to take advantage of his right to first refusal for 16.4 million Francs. Bernhard Burgener Bernhard Burgener Burgener's stake of 80% in Basel Dream & Vision AG has been stopped by a super-provisional restraining order. Bernhard Burgener Centricus, the British asset manager, could also own an interest. Burgener will still get the majority votes.
