Israel group fights over claims from the Shurat Hadin government

AN Israeli-based legal activist organization is calling on Australian survivors and their descendants to join its class action campaign against insurance companies whose Holocaust-era antecedents failed to pay out on policies held by dislocated and murdered European Jews.

Israeli lawyer and human rights advocate Nitsana Darshan-Leitner, founder of Shurat HaDin Israel Law Centre she told The AJN that the centre's initiative, Project Last Chance, will sue insurance companies who used the chaos of World War II and the Shoah to avoid paying claims to survivors, victims and their descendants.

Darshan Leitner indicated that US Senate estimations have proven that $US200B in payments were withheld by Jewish policyholders who had delinquent WWII insurance firms. This includes many who have traceable successors in today's market who have taken on these liabilities.

Shurat HaDin is using its experience to investigate banks that hold assets of terrorist organisations.

"We've taken legal action against governments, against banks, against companies that have been aiding and aiding in the spread of the spread of terrorism. We've got the information and we're not scared of taking on countries that are large corporations, or international banks," she stated.

Separately, Shurat HaDin is launching legal action in Israel to open the database of more than 140,000 Holocaust survivors and descendants - who have listed more than two million assets under Israel's Project Heart from 2011-14. The Israeli government and the Jewish Agency for Israel jointly welcomed applicants to the restitution program. The program, however, was abruptly ended, leaving those who participated in the program in limbo.

Shurat HaDin contacted the government to get clarifications, but was not able to get a response. Israel's Labour and Social Services Ministry declared the following: Project Heart was never meant to be a single-claims program, therefore the claims names of claimants cannot be released. Another theory suggests that Israel did not realize the reticence of European governments when confronted with lists of hundreds or thousands of applicants.

Darshan Leitner said that Project Heart participants could be candidates for class actions under Project Last Chance if their identities were disclosed to Shurat haDin.


Project Last Chance was a new approach to the Claims Conference. She stated that it has petitioned government officials for Holocaust Restitution instead of specifically targeting companies and companies.
