The UN Human Rights Council investigation (Shurat Hadin)

On the afternoon of a Sunday, Nitsana Darshan Leitner who is a lawyer at the Israel Law Center in Tel Aviv, outlined the challenges facing the State of Israel would face from the United Nations over the next few weeks.

Her serene and calm manner of speaking is in stark contrast to the intense opposition Israel faces from the UN Human Rights Council (COI) and the three-member Commission of Inquiry [COI] that was appointed by the UN to investigate "in the Occupied Palestinian Territory including East Jerusalem all allegations of violations of international humanitarian laws and all alleged abuses of international rights law from April 13 to April 13th 2021."

While Israel has faced an aggressive UN investigations in the past, the main difference is that the current UN inquiry was established as a permanent investigation to probe Israel's IDF. The time frame of this commission has not been decided.

Darshan-Leitner founded Shurat HaDin in 2003. "The UN Human Rights Council inquiry is not emerging in a vacuum," she explains. "It is in connection with the goings-on of the International Court of Justice in The Hague."

In 1998 the Rome Statute gave birth to the ICC. The court has the authority to prosecute individuals for crimes such as genocide , and crimes against humanity. Israel, the US and a host of other nations have not ratified or signed the law and are not under any legal obligation to adhere to the decisions of the International Court of Justice.

Fatou Bensouda the ICC prosecutor from The Hague announced in March 2021 that she will be opening a war-crimes probe against Israel, Hamas, and other nations.

A judgment from the International Court in favor of Israel could have a profound impact on. Most European countries and Scandinavians are members of the court and are legally required to follow the decisions of the court. If the ICC could decide that IDF soldiers were guilty of war crimes or other crimes, any Israeli who was a part of IDF military operations who would travel to countries which have been deemed members of the court, like Canada, Australia and New Zealand - could be arrested. Harsh economic sanctions may be applied to the Jewish state as well as the banking industry.

Israel may be facing other threats, including sanctions, weapon embargoes or boycotts. For instance, El Al or other Israeli transporters might not be allowed to operate in certain countries.


Bensouda's prosecutor's tenure ended in June 2021. she was replaced by British barrister Karim Khan. The new prosecutor was able to inherit 14 investigations from Bensouda and eight of them were in the process of being investigated. Darshan Leitner explains that he classified all items on his docket in the planning phase which was to the astonishment of Palestinians. This was an acceptable way to say that the allegations were not worthy of the court's attention or weren't urgent enough.

Darshan Leitner said that "this upset the Palestinian Authority." "They were unable to comprehend the reason for their efforts to convince the prosecutor to launch an inquiry have failed."

In the month of September, 2021 PA demanded the creation of a Commission in the International Court of Justice to persuade Karim Khan to reconsider his position.

Darshan Leitner claims that the PA continues to blame Israel for war crimes and apartheid since then. The Amnesty International report, released in early February in February, in February, accused Israel of committing apartheid violations within and beyond the Green Line. The report stated that Israel had "established and sustained an institutionalized system of oppression" toward Palestinians. Additionally, it accused Israel for racial separatism of Palestinians that dates back to 1948.

The UN's commission of inquiry is the latest initiative by the Palestinians to convince the court in The Hague to be convinced. Navi Pillay, South Africa's leader, heads the group of three members, which also includes Miloon Kathari (India), Chris Sidoti and Chris Sidoti.

Darshan Leitner reports that Pillay Kothari (and Sidoti) are well-known for their biases in favor of Israel. "Pillay herself has been accused of blaming Israel for apartheid. She was also the spokesman behind the anti-Semitic Durban conferences. The other groups aren't far behind."

From February 28th until April 1st From February 28th to April 1st, the UN Human Rights Council will hold its 49TH session (HRC49).

The report from the commission of inquiry on Operation Guardian of the Walls will be the most significant aspect of the session. It will examine the Israeli operation against Gaza in May 2021 to stop Hamas from launching missiles towards Israel. The past experience, she states, shows that it's unlikely Shurat HaDin or any other person, for that matter is able to convince people who are negative about Israel to change their minds.

Darshan Leitner states, "We will launch a campaign that calls for the resignation of the entire COI members." "We will launch a mass petition against the COI and its members, and any other person who assists this committee," Darshan Leitner stated.

Shurat HaDin will also prove that the PA and not Israel is the most serious people who violate human rights. "We will scan their legislation to uncover the gender discrimination that is imposed on children and women and their flawed legal systems. "This is just one example of the United Nations' champions of human right that they want to assist. While they claim Israel of apartheid, the United Nations promotes a tyranny with no elections in 15-years and that regularly infringes on the rights of its own citizens.

Darshan Leitner claims that Shurat HaDin is also going to reveal to the world the ways minorities in Gaza and in the PA are treated. "The fate of Christians living in Gaza and the PA territory is set," she states. Their numbers are constantly decreasing. Islamic extremists who demand the slaughter of "infidels" and who are not any better than ISIS numbers are increasing is an Islamic extremists.

Shurat HaDin leader believes that Israel committed serious errors in the handling of the 2009 UNHRC investigation into Richard Goldstone, a South African jurist. Jerusalem was not willing to cooperate with the Goldstone Commission in that scandalous incident. The Goldstone Commission was led by Richard Goldstone, an South African jurist. The repercussions of the harshly critical final report, however, created a great deal of tensions in the international political arena for Israel.

"I believe we didn't play our cards well, even though I agree with Israel's refusal to cooperate or facilitate the hateful Goldstone witch-hunt. It's not enough just to ignore the UNHRC and declare them as prejudiced and haters. The government had to complement its decision by launching a well coordinated and active campaign to disseminate government's narrative and counterattack against the antisemitic UNHRC. She suggests that we be vocal, take action and pursue legal actions in situations where the government's hands are bound."

Darshan Leitner hopes to fill the void. She summarizes the current circumstances and states that the PA's goal is to ultimately influence the Hague's Chief Prosecutor. Therefore, "if I can uproot the foundation of the commission to expose how erroneous it is, how the notion of apartheid is wrong and more appropriate to the PA and the PA's agenda, it will demonstrate that the commission has no significance.

"If we do not take this action then the consequences could be catastrophic. The prosecutor could be influenced or reconsider his decision. If he does, it will be a tragedy as well as an opportunity to change the game. It's not possible to do this.
