AN Israeli-based legal activist group is urging Australian survivors and their descendants to join its class action program against insurance companies that have failed to pay out on policies held by displaced and killed European Jews.

Nitsana Darshan Leitner Nitsana Darshan, an Israeli lawyer and human rights advocate stated she believes that Shurat HaDin Israel Law Centre was the genesis of Project Last Chance. It will pursue insurance companies who made use of the chaos of World War II or the Shoah in order to avoid paying victims, survivors and their descendants.

Darshan Leitner said that US Senate estimates showed that up to $US200 billion was withheld from Jewish policyholders as a result of delinquent WWII insurance companies of the time. There are numerous identifiable successor entities on the market today, which could be traced back to these debts.

Shurat HaDin is leveraging its expertise in pursuing financial institutions like banks that hold the funds of terrorist groups.

Shurat Haidin is also planning to launch legal proceedings against Israel to get access to the list of 140,000 Holocaust survivors/descended who have listed approximately two million assets as part of Israel’s Project Heart. The Israeli government as well as the Jewish Agency for Israel jointly invited applicants to join the restitution programs. The program, however, was abruptly ended which left the people in limbo.

Shurat HaDin tried to contact the government to get clarifications, however, she was unable to receive a response. However, Israel Law Center and Social Services Ministry said Project Heart was never intended to be a scheme for individual claims, so claimants' details cannot be released. A theory suggests Israel underestimated European governments' intransigence when confronted with the list of hundreds of thousand of claimants.

Darshan Leitner said that if they're identified to Shurat HaDin, Project Heart participants may be qualified for class actions under Project Last Chance.

Project Last Chance's approach is different to the approach of the 1951 Claims Conference. They petition governments for Holocaust restitution.
