Shurat Hadin said that such the move was possible because global Ben & Jerry's (and its parent company, Unilever) had announced plans to stop selling to those regions to protest Israeli policies.
Shurat HaDin's Law Center is now registered as an entity as a corporation with Israel's register of corporations. The name is "Judea and Samaria's Ben & Jerry's", wrote Shurat HaDin's president Nitsana Darash-Leitner, in a note she wrote to Unilever, an British multinational company based in the UK. Unilever owns the Vermont-based Ben & Jerry's worldwide since 2000.
Shurat Hadin announced that Ben and Jerry's brand name will be used to represent Vermont's ice cream line and will also introduce new flavors. Leitner added that "we are confident" business can expand into the areas where that was abandoned.
Unilever was informed that it did not have the legal right to use the Ben & Jerry’s label in the region. This is in spite of the fact that the boycott is not set to begin in 2023 until the expiration of the existing agreement with local ice-cream producers.
Avi Zinger is the franchisee of the franchise in Israel. Avi Zinger has made it clear his plan to stick within the Green Line regarding ice cream sales will not be affected by the Green Line.
Shurat HaDin wrote in an email to Unilever: "We will actively and vigorously defend our Ben & Jerry’s name rights, trademarks, rights and trademarks in the region by every legal means."
She told The Jerusalem Post that sales are limited to those areas which Ben & Jerry's has withdrawn from. Shurat Hadin of Unilever to sell new Ben & Jerry's to Israel's areas that aren't in the "Occupied Palestinian Territory", means that they can't be sold in the OPT.
Darshan Leitner has also said that the Israeli franchise contracts are no longer valid and that ice-cream sales would be possible once they expire.
