Bernhard Burgener vs David Degen is another move in the FC Basel owner dispute. The Board of Directors supports Burgener's plans. However, it's not possible to come to an agreement.
Monday morning saw the meeting of FC Basel Holding AG's Board Directors. A majority of the committee of four comprised of Burgener and Degen along with Karl Odermatt and Peter von Buren agreed with the plans of the previous owner. He requested Degen to transfer his stake to the potential buyer, Basel Dream & Vision AG, according to an official statement from the company that holds it.
Burgener's shares can be sold to minor shareholders by the Board of Directors under the conditions of a contractually defined law. The Board of Directors says that the right to presale of Degen is overridden by the dragalong rights.
Burgener and his group have made a move on the dispute over the owners. Degen insists upon his right to first refusal. He wants to use it to the value of 16.4 millions francs. Burgener is prevented from selling his stake of 80 percent by the former player through a super-provisional order. Centricus which is an asset manager from the UK, British asset manager, will also be able own an interest in the new company. Burgener still would have the majority vote.
According to FC Basel Holding AG Announcement, Burgener und Degen are fast seeking an outcourt settlement "in favor of FCB".
