Under the Streamlined Voluntary Disclosure Program, there is no penalty on the taxes that are due – although interest is due for each year of tax liability. While it sounds very “Cloak and Dagger,” it’s not – it is the same site whether you have accounts in Switzerland, Cayman Islands, Bahamas, Japan or India. While the IRS likes to keep this term a big secret, it generally means a person acted with either Intent, Knowledge or Reckless Disregard in not reporting Foreign Accounts, etc. It is based on a totality of the circumstances surrounding the non-disclosure.

But it is absolutely essential that you very carefully discuss this option with your advisor in order to fully understand your risks before you decide to move forward with it. Revisiting their pre-existing practices is necessary to ensure compliance with the evolving FATCA landscape. Kunal has been really helpful in getting me compliant per the streamline procedures. Kunal was aware of all the nuances related to FATCA and FBAR procedures and gave appropriate recommendation and advice. The group includes former government officials from the IRS, Department of Justice and the Treasury who have strategic relationships within Congress and who have presented before the Senate Finance and House Ways and Means Committees.
If the amount is quite high and 5% is in fact a large figure, it makes sense to roll the dice in the hopes of reducing the penalty. Think of it as “hiding in plain sight.” The risk is that if you get spotted you are, well, in plain sight. You are at the mercy of the auditor, and auditors have recently been instructed to crack down on quiet disclosures. I’ve been putting clients through the IRS’ Offshore Voluntary Disclosure Program and while they have been making efforts to simplify it over the years, there are some very complex details to consider, options to weigh, and judgment calls to make. In fact, FATCA itself doesn’t actually require U.S. citizens to do anything.
Generally, if you were non-willful and you want to get into compliance, your immigration status should be safe. There are two types of streamlined OVDP disclosures depending on whether the violator was a resident or non-resident when the filings should have been made. The Statement of Understanding (completed by U.S. citizens seeking to relinquish U.S. citizenship) provides in part that renunciation may not provide exemption from U.S. income taxation. If the Department of Homeland Security determines that the individual renounced for the purpose of avoiding taxation by the United States, Section 212 of the Immigration and Nationality Act provides that the individual will not be admitted to the United States. An applicant for an original SSN who is under age 12 may apply by mail. The applicant can send the completed Social Security form SS-5 and required proofs to the servicing FBU.

In general, the average processing time once the individual completes the process abroad and submits the required paperwork to the Department of State for approval is two to three weeks . For wait times for loss of nationality appointments, individuals may check the website of the closest U.S. embassy or consulate that provides the service. If the applicant lived in the United States and is applying for an original Social Security number, the applicant may be asked for information about the schools they attended or to provide copies of tax records that would show they were never assigned an SSN.
Unlike traditional OVDP, in which the IRS pretty much states that as long as a person fully discloses and fully cooperates with the IRS, he or she will not be audited — under the streamlined program the IRS can still audit the applicant. Under traditional OVDP, there is a 20% penalty for each year of unpaid tax liability.
Applicants age 12 and older who have never had a SSN before must have an in-person interview. Under U.S. law, a person may acquire U.S. citizenship at birth by birth in the United States or by birth abroad to a U.S. citizen parent or parents who meet the statutory conditions prescribed by Congress. A foreign-born person who does not acquire U.S. citizenship at birth may acquire U.S. citizenship at some point after birth as provided by Congress. A civil FBAR Penalty is a penalty that is focused on monetary fines or warning letters — without any risk of criminal investigation or prosecution.
Please call our office to get learn how we are engaging with current clients and new at this time. We will discuss why a Quiet Disclosure is not worth the risk, and how to safely and cost-effectively get into compliance. If the inquirer needs written proof of SSN, he or she must submit an application for a replacement SSN card. SSA is prohibited by law from disclosing the SSN by phone or letter, even to the number holder. Please note that this inquiry must be made directly to a FBU and cannot be made at a consular section of an embassy or consulate overseas that does not have a Federal Benefits Unit. If the SSN is unknown, SSA can search for the SSN with the biographical information. If no SSN is found, then SSA will send a letter stating that fact and ask the applicant to apply for an SSN.
This is not true if you make the mistake of consulting with any non-attorney, even a CPA. Call now to receive a free, thorough, and completely confidential consultation. Talking directly with FBAR tax attorney Andrew L. Jones, you will learn which solution is right for you.
It is possible for an individual to reside in only one country and yet be considered a tax resident of multiple countries. The most common example of multiple tax residency is whereby a U.S. citizen or U.S. permanent resident visa holder resides outside the U.S. U.S. citizens and permanent residents are always U.S. tax resident regardless of also being characterized as tax resident of another country.

This law firm website and legal marketing are managed by MileMark Media. Richard S. Lehman has over 40 years of practicing tax law in the United States. The test for willfulness is whether there was a voluntary intentional violation of a known legal duty. The burden of establishing willfulness is on the Internal Revenue Service and if it is determined that the violation was due to reasonable cause, the willfulness penalty will not be asserted. No matter where in the world you reside, our international tax team can get you IRS offshore compliant.
Its hundreds of pages worth of regulatory burdens falls directly on non-U.S. financial institutions who need to “phone home” to the U.S. government about their U.S. citizens. The OVDP we know today kicked off in 2012 with no time limits or deadlines but the IRS reserved the right to move the goalposts whenever they saw fit. In other words, changing the rules, conditions, or penalties do not require a whole new “program” and they can just stick with this one. The main objective of the “Program” is to reel in the non-compliant “fish” who fit the classic profile of a tax evader that politicians love to hate.
Willful FBAR penalties will be asserted in accordance with existing IRS penalty guidelines under IRM 4.26.16 and 4.26.17. Under the new version of the Voluntary Disclosure Program, the IRS sets the penalty to amount in the code, and enforcement procedures follow the IRM, which is the Internal Revenue Manual. Financial institutions can use the FATCA registration system to manage their accounts.
We currently represent clients in the United States and Internationally. Teig previously served as an Adjunct Professor of Federal Tax Research at the University of Miami School of Law Graduate Program in Estate Planning from 2001 thru 2008. Teig's background in research helps him build and support detailed positions for his clients which are easy for IRS representatives to understand. Making complex issues simple is the secret to our success with the IRS. The country in which an individual primarily resides is not definitively the country of tax residence, or at least not the sole country of tax residence.
Properly completed and signed agreements to extend the period of time to assess tax and to assess FBAR penalties. Preliminary acceptance into the OVDP is conditioned upon the information provided by the taxpayer being—and remaining—truthful, timely and complete. “Qualified” as in explained or justified and “quiet” as in formally unannounced under the OVDP. You start by entering the OVDP and then, before the process is complete, you opt-out again, saying that you believe, for certain qualified reasons, that your case belongs in the “parallel universe” of quiet disclosure rules where auditors are known to assess 0% instead of 5% as in the OVDP. You may have already been touched by FATCA in the form of a “thanks but no thanks” from institutions that simply don’t want the compliance liability that a U.S. citizen causes them now.
It is highly recommended that you seek the advice of a trained Professional with experience not only in the laws surrounding the 2020 strategies, but also how they are enforced in real life. If someone has a relatively small amount of money overseas, paying 5% to be over and done with the issue seems like a reasonable idea.
The general term that refers to voluntarily coming into IRS Offshore Compliance by reporting Foreign Bank Accounts, Financial Assets, Income and other Foreign Investments. The IRS Streamlined Program was created in 2014 to assist individuals who are non-willful and meet other filing requirements. It is a much more “Streamlined” submission with less reporting requirements. The Streamlined Voluntary Disclosure Program is an alternative to voluntary disclosure. If you have received this FATCA letter, it means that under the FATCA regulations, your bank has detected “US indices” on your account which identify you as a likely US account-holder.
A person may inquire in person with a FBU to find out if he or she already has an SSN. The FBUs can provide the SSN in person if that person provides proper identification. The FBU cannot provide any written confirmation of the SSN other than a replacement SSN card.

I would highly recommend his services and will definitely use his services again. Each year the IRS rolls out campaigns to identify the the top compliance issues for the year. For each of these campaigns, the IRS will deploy resources, training, and tools, metrics and feedback to enforce compliance in these areas. One recent campaign that may have a substantial impact in the world of offshore compliance is the FATCA campaign.
An original foreign passport is acceptable for identification purposes but must be accompanied by proof of U.S. citizenship, such as a U.S. birth certificate, a full validity unexpired U.S. passport, a Consular Report of Birth Abroad of a U.S. If the U.S. citizen naturalized, he/she may present a Certificate of Naturalization (N-550/N-570) or a Certificate of Citizenship (N-560/N-561) as proof of U.S citizenship. In most cases, a full-validity, unexpired U.S. passport is sufficient proof of U.S. citizenship, age, and identity, but for purposes of an application for a Social Security card/number, it can only be used to establish any two of these three facts. For example, if the U.S. passport is offered to establish U.S. citizenship and identity, another document, such as a birth certificate, would be needed to establish the age of the applicant. Section 205 of the Social Security Act provides that applicants must submit evidence to establish their age, identity, and citizenship or lawful non-citizen status.
Cross border taxation happens to be such a complex subject, though the “Program” started turning up quite a number of “non-willful” violators a.k.a. innocent bystanders who had made honest mistakes. In addition, appropriate cases may be referred to IRS Criminal Investigations and/or the Department of Justice for criminal prosecution. Expatriation may have U.S. tax consequences, including the imposition of an exit tax. You should review the materials at the following links before expatriating to determine your potential U.S. tax consequences, if any. It may take up to several months after the individual’s initial inquiry to complete a loss of nationality case.
Unlike the streamlined program, there is no non-willfulness element. For many individuals, depending on the facts and circumstances of their case, they may still choose to enter traditional OVDP in order to avoid the unknown of whether they will be audited or examined under the streamlined program.
