In its findings of fact, the commission affirmed that Morris was stun-cuffed at Gallagher's advice. This was because the bailiffs believed that Morris was a security risk due to his disruptive behavior in court and in prison. The commission determined that Gallagher was able to direct Morris to undergo shocks during the trial but not in the presence of the jury. Gallagher ordered the shocking in response to Morris "moving around the back of the counsel table and then into the well of the courtroom in an act that Judge Gallagher perceived to be an omen of security." The commission concluded that the record of the trial court was devoid of any indication of a security threat.

Even Morris lawyer, Bill Ray, told Texas Lawyer that he was not opposed to the court's use of stun belts because his client was acting "like an armed cannon that was ready to go off."



But the problem with constitutional rights is that they're granted dependent on the subject being a good person. "The trouble is, now Morris, previously a convicted pedophile sentenced to 60 years for sexting his ex-girlfriend's 15-year-old daughter, wins a get-out-of-jail card and a new trial" Floyd wrote.
