Laryngeal Cancer and Railroad Settlement
Asbestos, diesel exhaust and other hazardous substances can be a danger for railroad workers. Contact an experienced FELA lawyer if you suspect that your railroad work can be the cause of cancer or other illnesses.
Speech and language therapy might be an option if your cancer progresses and you are required to undergo surgery to remove your voice box (laryngectomy). You may also be able to get a voice implant to help you talk.
Compensation
The Federal Employers Liability Act (FELA) allows railroad workers to file lawsuits directly against their employers in the event that they can prove they were exposed to asbestos or other harmful chemicals at work. Many times, these toxic exposures can cause serious side consequences, such as cancer and other illnesses. While lung cancer is the most widely-known disease linked with rail work, other ailments can be traced back to years spent working on the job.
If a person is diagnosed as suffering from a condition that is related to their job, they may require expensive medical treatment. Additionally, they can be affected by a loss of wages and other financial burdens.
A cancer settlement on the railroad can help pay for these expenses. However, the initial settlement offer could be much less than what a person is entitled to receive. A lawyer who is experienced in railroad accident cases can analyze the settlement offer to determine if that it meets the needs of a victim.
Doran & Murphy successfully represented an ex-engineer of a locomotive who suffered from laryngeal cancer after years of exposure to toxic chemicals. During his time in the industry, the plaintiff sprayed creosote and degreasing solvents on trains, as well as handled silica sand, contaminated fuel and asbestos. The plaintiff alleged that these exposures led to his cancer and other chronic illnesses. He was awarded $7.5 million in damages.
Legal Representation
During the 19th and 20th century, railroaders faced hazardous working conditions which put them at risk for accidents such as derailments, or collisions. The workers were also exposed substances such as diesel exhaust and asbestos. If these exposures resulted into a cancer diagnosis, then the individual and his or family members may be entitled to compensation.
Railroad workers who contract cancer should consult with a knowledgeable lawyer from the railroad industry to discuss their options. They should not wait until the time limit expires. If their cancer is linked to their work-related exposure the patient could be awarded substantial compensation.
In Non-Hodgkin's lymphoma lawsuit settlement filed on behalf of an engineer who worked as a locomotive engineer for the Grand Trunk Railway by Doran & Murphy, a jury awarded damages of $872,000, after finding that exposure to diesel fumes as well as asbestos contributed to his throat carcinoma. The verdict was made without taking into consideration the engineer's history of smoking cigarettes, since it was evident from the evidence that exposure to diesel fumes as well as asbestos in the workplace was the cause of the condition.
