Multiple Myeloma Caused by Railroad Work
Under FELA railroad workers are entitled to bring lawsuits to seek compensation for their injuries. However, in order to succeed in bringing a claim, the injured person must prove that negligence on the part of the railroad played a role in causing their injuries.
The evidence presented at the trial included testimony of an toxicologist who used a variety of studies and risk ratios to show that Harris's multiple myeloma was triggered by the exposure to diesel exhaust.
Benzene Exposure
Benzene exposure is associated with a range of hematopoietic tumors that include Acute Myeloid Leukemia (AML), Acute Non-Lymphocytic Leukemia (ANLL) and Multiple Myeloma. According to the International Agency for Research on Cancer (IARC) the chemical the classification of benzene is Group 1 carcinogen. This chemical can be found in diesel fumes and railway workers are regularly exposed to it.
Railroad workers can also be exposed by cleaning products such as CRC or Safety-Kleen. These cleaning agents contain a specific benzene known as methylbenzene. When methylbenzene gets into contact with water, it is converted into a chemical known as dioxin. Dioxins are a class of substances that can lead to many serious health problems, including lung cancer.
Parker Waichman has successfully represented many railroad workers in personal injury lawsuits against their employers under FELA. A jury handed down $7.5 million to an ex- Chicago and North Western Railroad employee diagnosed with acute myeloid cancer after years of exposure.
In a different case, a plaintiff was diagnosed with multiple lymphoma after several years of employment as a railway signal maintenance technician. He claimed that his condition was caused from exposure to diesel exhaust as well as the benzene he encountered while working. Prior to the commencement of trial, BNSF filed a motion for summary judgment based upon the idea that plaintiff was aware or should have known his cancer was a result of the exposure to chemicals and environmental hazards while working for the railroad.
Creosote Exposure
A toxic chemical that is used as a wood preserver, creosote has been associated with several cancers, including skin and scrotal cancer. This chemical is often a issue for railroad workers who work on the maintenance and repair of railway ties. The National Toxicology Program reported that those who handled creosote were at more risk than general population of developing fatal forms of cancer.
A recent court case in which a railroad employee who was diagnosed with myeloma, alleges his occupational exposures to diesel exhaust and other environmental hazards caused the cancer. The judge ruled that the plaintiff was aware of the potential negative effects of his work at the railroad and could have found out about his injury via a reasonable internet search prior to the time when he was diagnosed. The plaintiff did not take the necessary steps and his case is now time-barred.
In a different instance, the railroad was able to win a defense decision in a suit filed in Philadelphia County by a former railroad employee. The plaintiff claimed that the cause of his illness was bladder cancer as a result of his occupational exposure to smoke and other chemicals such as diesel exhaust and creosote.
Parker Waichman has also secured defense verdicts in cases involving other types of cancers such as prostate and lung cancer, brought by former railroad workers who claimed their cancers were caused by the constant exposure to toxic chemicals on the job. The firm is ready to analyze the facts of your case and discuss your options.
Asbestos Exposure
Asbestos can be a problem for railroad employees. This is often the case when workers handle railroad ties, or repair or install railway equipment. Asbestos is known to cause lung cancer, mesothelioma and other illnesses.
In a lawsuit filed against CSX Transportation, plaintiff Ronald K. Harris claims that he developed multiple myeloma because of his work for the railroad. Harris according to the lawsuit, was employed every day by CSX Transportation in its Laredo railroad yard. As a result, he inhaled "harmful toxic chemicals, fumes, agents, particles, and substances that include but are not only diesel exhaust, welding fumes, creosote, carbon monoxide and phenols. dioxins, and heavy metals."
We successfully represented our client in a two-week jury trial in which it was alleged that the repetitive bending, lifting and twisting during the course of work resulted in herniated lumbar disks, and an indefinite disability of 25% that resulted in a loss of wages as well as pain and suffering. The railroad was not found to be negligent, and the plaintiff received only a minimal award.
Environmental Exposure
Railroad workers are exposed various environmental chemicals. This exposure can cause a variety of health problems including multiple myeloma, based on the type and amount of the work. If you or someone you love has been diagnosed with multiple myeloma because of work done on the railroad, you should contact Parker Waichman to discuss your options.
In Kidney cancer lawsuit received $7.5 million from a jury following his diagnosis with myelodysplastic syndrome (MDS) and acute myeloid leukemia. He sued two major railroads, claiming that exposure to diesel exhaust and asbestos led to his health issues.
The railroads filed a motion for summary judgement arguing that, at the time of the plaintiff's diagnosis the plaintiff was aware of all the details and causes of the injury. The court ruled in favor of the railroads' motion concluding that the plaintiff failed to make a reasonably diligent inquiry into whether his health condition was related to his railroad employment.
At trial the plaintiff offered expert testimony from an industrial hygiene specialist and epidemiologists. The experts claimed that Harris's myeloma resulted of the exposure he received to diesel exhaust. The expert witness referenced a variety of studies to prove this. These studies showed an association between diesel exhaust and certain types of cancers. However, no respected scientist has ever claimed that diesel exhaust is the reason of multiple myeloma.
