How Railroad Lawsuit Chronic Lymphocytic Leukemia Has Become The Most Sought-After Trend Of 2023
Multiple Myeloma Caused by Railroad Work

Under FELA railroad workers are able to sue for compensation for injuries. However, to make a claim that is successful, the injured party must prove that negligence on the part of railroad workers was the cause of their injury.

The evidence presented in the trial included testimony from toxicologist who utilized various studies and risk factors to prove Harris's myeloma was caused by his exposure to diesel exhaust.

Benzene Exposure

The exposure to benzene can be linked to a variety of hematopoietic malignancies which include Acute Myeloid Leukemia (AML), Acute Non-Lymphocytic Leukemia (ANLL) and Multiple Myeloma. According to the International Agency for Research on Cancer (IARC), the chemical is classified as a Group 1 carcinogen. This chemical can be found in diesel fumes and railway workers are regularly exposed to it.

Lymphoma lawsuit are exposed by cleaning products such as CRC or Safety-Kleen. These kinds of cleaning products typically contain a type of benzene referred to as the methylbenzene. When methylbenzene comes into contact with water, it is converted into a chemical known as dioxin. Dioxins can cause lung cancer as well as other serious health issues.

Parker Waichman has represented railroad workers in personal injury cases against their employers, under the FELA. For Kidney cancer lawsuit , a jury awarded an ex- Chicago and North Western Railroad worker $7.5 million for his diagnosis of acute myeloidleukemia after years of exposure to chemicals and solvents on the job.

Another case involved a plaintiff who was diagnosed with multiple myeloma while working as an engineer for railroad signal maintenance for a period of time. The plaintiff claimed that his illness was the result of exposures to diesel exhaust and benzene that he encountered on the job. Prior to the commencement of trial, BNSF filed a motion for summary judgment based upon the idea that plaintiff was aware or could have realized that his cancer was caused by his exposure to chemicals as well as environmental hazards during his railroad employment.

Creosote Exposure

A toxic chemical used as a wood preservative, creosote has been associated with various cancers, including skin and scrotal cancer. Creosote is a common issue for railroad workers who work on the maintenance and repairs of railway ties. The National Toxicology Program has reported that workers who work with creosote face a higher risk of developing cancer lethal than the general population.

In a recent court case, railroad workers sued after being diagnosed with multiple myeloma. He claimed that work-related exposure to diesel exhaust and other environmental hazards caused cancer. The court ruled that the plaintiff was aware of any potential dangers he might suffer from his railroad job and could have found out about his condition by conducting an extensive internet search before the diagnosis came in. Since he was not able to undertake this task his action is deemed to be time-barred.

In a different case, the railroad was able to win a defense verdict in a lawsuit brought in Philadelphia County by a former railroad employee. The plaintiff claimed he was diagnosed with bladder cancer due to his occupational exposure to secondhand smoke and other chemicals, such as creosote and diesel exhaust.

Parker Waichman has also obtained defense verdicts for cases involving other types cancers, such as lung and prostate cancer. These cases were brought by former railroad workers who claimed that their cancers were due to a lifetime exposure to toxic chemicals at work. The firm is prepared to review your case's details and discuss your options.

Asbestos Exposure

Asbestos is a concern for railroad employees. This is often the case when railroad workers work with railroad ties, or repair or install railway equipment. Asbestos exposure can cause mesothelioma, lung cancer and other diseases.

In a case brought against CSX Transportation, plaintiff Ronald K. Harris claims that he developed multiple myeloma as a consequence from his work for the railroad. Harris, according to the lawsuit, was employed every day by CSX Transportation in its Laredo railroad yard. As a result Harris breathed in "harmful chemical substances, toxic chemicals, fumes, substances, particles, and other substances that include but are not including diesel exhaust creosote, welding fumes, carbon monoxide, phenols, dioxins and heavy metals."

We successfully defended our clients in the trial of a jury that lasted two weeks, where it was claimed that the repetitive lifting and bending while working as trackmen caused herniated discs in the lumbar region. This resulted in an impairment of 25% that resulted in loss of wages as well as discomfort and pain. The railroad was not found to be negligent and the plaintiff received only a modest amount.

Environmental Exposure

Railroad workers are exposed to various environmental chemicals. This exposure can trigger various health issues such as multiple myeloma. This is based on the nature and intensity of the work. If you or someone you love has been diagnosed with multiple myeloma because of work done on the railroad, you should contact Parker Waichman to discuss your options.

In Lymphoma lawsuit that was recently heard, railroad workers received $7.5 million from the jury after being diagnosed with myelodysplastic syndrome (MDS) and acute myeloid leukemia. He filed a lawsuit against two major railroads, claiming that their exposure to diesel exhaust and asbestos led to his health issues.

However, the railroads filed an appeal to a summary judgment, arguing that the plaintiff was aware of most important facts and potential causes of his injury by the time he was diagnosed. The court agreed with the railroads and granted their motion, concluding that the plaintiff hadn't conducted a reasonable investigation to determine whether his condition was related to his railroad work.

At trial the plaintiff provided expert testimony from an industrial hygienist and epidemiologists. Expert witnesses stated Harris's myeloma was the result of his exposure to diesel exhaust. The expert witness cited numerous studies to prove this. These studies revealed the connection between diesel exhaust and certain types of cancers. But, no reputable scientist has ever claimed that diesel exhaust is the cause of multiple myeloma.
