Seven Reasons Why Railroad Lawsuit Chronic Lymphocytic Leukemia Is Important
Multiple Myeloma Caused by Railroad Work

Under FELA railroad workers are able to sue to recover compensation for injuries. To be successful, the person who was injured must prove the railroad was negligent in causing injury.

The evidence presented at the trial included testimony from toxicologist who utilized various studies and relative risk factors to prove that Harris's multiple myeloma caused by his exposure to diesel exhaust.

lung cancer lawsuit from smoking is associated with many hematopoietic tumours, including Acute Myeloid Leukemia(AML), Acute Non-Lymphocytic Leukemia(ANLL) and Multiple Myeloma. According to the International Agency for Research on Cancer (IARC), the classification of benzene is Group 1 carcinogen. This chemical is found in diesel fumes, and railroad workers are frequently exposed to it.

Some railroad workers are exposed by cleaning products like Safety-Kleen or CRC. These kinds of cleaning agents typically contain a kind of benzene referred to as the methylbenzene. When methylbenzene gets into contact with the water, it transforms into a chemical known as dioxin. Dioxins can cause lung cancer and other serious health issues.

Parker Waichman has represented railroad workers in personal injury cases against their employers, under the FELA. A jury awarded $7.5 million to a former Chicago and North Western Railroad employee who was diagnosed with acute myeloid carcinoma after years of exposure.

In another instance the plaintiff was diagnosed with multiple lymphoma after several years of employment as a railway signal maintenance technician. The plaintiff claimed that his condition was caused from exposure to diesel exhaust and by the benzene that he was exposed to during his work. Before the beginning of trial, BNSF filed a motion for summary judgment based on the idea that plaintiff knew or ought to have known that his cancer was a result of his exposure to chemicals as well as environmental hazards during his railroad employment.

Creosote Exposure

A poisonous chemical that is used as a wood preservative, creosote has been associated with several cancers, including scrotal and skin cancer. Creosote is a common issue for railroad workers who work on the maintenance and repairs of railway ties. The National Toxicology Program reported that those who handled creosote were at more risk than general population of developing lethal forms of cancer.

In an upcoming court case, a railroad worker sued after being diagnosed with multiple myeloma. He claimed that work-related exposure to diesel exhaust and other environmental dangers caused cancer. The judge determined that the plaintiff was aware of the possibility of negative effects of his work at the railroad and could have discovered the injury through a reasonably diligent internet search at the time he was diagnosed. Since he was not able to make this effort his action is deemed to be time-barred.

In a separate case the railroad was successful in defending its decision in a case filed in Philadelphia County by an ex-railroad worker. The plaintiff claimed that he was diagnosed with bladder cancer due to his occupational exposure to smoke, as well as other chemicals such as diesel exhaust and creosote.

Parker Waichman has also secured defense verdicts in the cases involving other types of cancers, such as prostate and lung cancer, which was brought by former railroad workers who claimed their cancers were caused by a lifetime of exposure to toxic chemicals on the job. Asbestos Exposure

Asbestos can be a problem for railroad workers. Workers are exposed to asbestos when they operate railroad ties, fix or install railway gear or work on railroad railway ties. Asbestos is known to cause lung cancer, mesothelioma and other cancers.

Ronald K. Harris, the plaintiff in a lawsuit brought against CSX Transportation claims that he was diagnosed with multiple myeloma as a result of his work at the railroad. According to the lawsuit, Harris worked for CSX Transportation at its Laredo rail yard on a regular basis. He inhaled "harmful and toxic substances, fumes and chemicals including but not limited diesel exhaust, welding fumes, and creosote.

We successfully defended our client during the two-week trial of a jury in which it was alleged that repetitive bending, lifting and twisting during the course of work caused herniated lumbar disks and an indefinite disability of 25% which resulted in loss of wages and suffering and pain. The railroad was not found to be negligent, and the plaintiff was awarded a small award.

Environmental Exposure

Railroad workers are exposed to a variety of environmental chemicals. Based on the type of work that is performed this exposure can result in a myriad of health issues, including multiple myeloma. Contact Parker Waichman if you or someone in your family has been diagnosed with myeloma as a result of working on railroads.

In a recent case, a railroad employee was awarded $7.5 million by a jury for having been diagnosed with acute myeloid lymphoma and myelodysplastic syndrome (MDS). He filed a lawsuit against two major railroads, alleging that exposure to diesel exhaust and asbestos caused his health issues.

The railroads filed a motion for summary judgement arguing that at the time of the plaintiff's diagnosis it was aware of the circumstances and causes of his injury. The court sided with the railroads and granted their motion, concluding the plaintiff had not conducted a reasonable investigation to determine if his illness was related to his work at the railroad.

At trial, the plaintiff presented expert evidence from an industrial hygienist and epidemiologists. railroad workers cancer lawsuit stated Harris's myeloma was the result of his exposure to diesel exhaust. In acute myeloid leukemia lawsuit of this claim the expert witness cited numerous studies that demonstrated the connection between certain types of cancers and diesel exhaust. However, no respected scientist has ever concluded that diesel exhaust is a cause of multiple myeloma.
