Creosote Exposure

Creosote, a toxic chemical used to preserve wood is linked to various cancers, including skin cancer and scrotal cancer. This chemical is often a problem for railroad workers who work on the maintenance and repairs of railway ties. The National Toxicology Program has reported that workers who work with creosote are at a greater risk of developing cancer that is fatal than the general population.

A recent court case in which a railway worker sought justice after being diagnosed with multiple myeloma. The case alleged that his occupational exposures to diesel exhaust and other environmental hazards caused the cancer. The court found that the plaintiff was aware of the damage he could incur from his work at the railroad, and could have learned about his injury by conducting an extensive internet search before he was diagnosed. He failed to do so and the case is now barred.

In a different case, the railroad was successful in defending its verdict in a suit brought in Philadelphia County by an ex-railroad worker. The plaintiff claimed he was diagnosed with bladder cancer due to his occupational exposure to secondhand smoke and other chemicals like creosote, diesel exhaust.

Asbestos Exposure

Asbestos may pose a health risk for railroad workers. The exposure is most often experienced when workers manage railroad ties or repair or install railway equipment. Asbestos is known to cause lung cancer, mesothelioma and other cancers.

In a case brought against CSX Transportation, plaintiff Ronald K. Harris claims that he contracted multiple myeloma due to the effects of his employment with the railroad. According to the lawsuit, Harris worked for CSX Transportation at its Laredo rail yard on a regular basis. He inhaled "harmful and toxic substances, fumes and chemicals including but not limited diesel exhaust, welding fumes and creosote.

The railroad was found not to be negligent and the plaintiff was awarded a small award.

Environmental Exposure

Railroad workers are exposed to a number of different environmental chemicals. In a recent case, a railroad employee was awarded $7.5 million by a jury for being diagnosed with acute myeloid leukemia and myelodysplastic Syndrome (MDS). He filed a lawsuit against two major railroads for claiming that exposure to asbestos and diesel exhaust caused health issues.

However the railroads subsequently filed a summary judgement motion, arguing that the plaintiff was aware of the fundamental facts and possible causes of his injuries at the time he was diagnosed. The court agreed with the railroads and granted their motion, concluding the plaintiff had not made a reasonable inquiry to determine if his condition was connected to his work at the railroad.

In the courtroom, the plaintiff presented expert testimony from an industrial hygienist and epidemiologists. The expert witnesses claimed that Harris's myeloma was the result of his exposure to diesel exhaust. To support this assertion, the expert witness referenced several studies that proved the connection between certain types of cancers and diesel exhaust. But, no reputable scientist has ever claimed that diesel exhaust is the cause of multiple myeloma.
