Railroad Lawsuit - Leukemia Caused by Benzene
A railroad worker who developed leukemia as a result of exposure to toxic chemicals was awarded $7.5 million in a verdict of a jury. He was employed by two different railroad companies, and was exposed to Benzene which is carcinogen.
The plaintiff's job required him to handle creosote coated ties and equipment. He claimed that the chemical was covering his entire body from head to toe.
Benzene
The chemical Benzene is among many hazardous chemicals that have been proven to cause cancer. It is a carcinogen that is present in diesel exhaust fumes which railroad workers are regularly exposed to. Exposure to benzene can be linked to myelodysplastic syndrome (MDS) and Hodgkin's Lymphoma and acute leukemia among other blood cancers.
Creosote and diesel exhaust as well as other carcinogens are a common exposure for railroad employees. While many railway workers are covered by workers' compensation, these benefits may not cover all the cost and expenses of a victim. A benzene suit against a railroad can aid plaintiffs in recovering damages that aren't covered by workers' compensation.
Kidney cancer lawsuit of railroad worker John Thompson won a benzene settlement against his employer. Her husband was an employee in maintenance of ways for the Chicago and North Western Railroad and the Union Pacific Railroad between 1976 between 1976 and 2008. He was exposed to a range of petroleum solvents including creosote with benzene in it distilates of coal, naphtha and paint strippers. John was diagnosed with various cancers including myelodysplastic lukemia during his career. He died in November 2009 of this illness. The jury awarded him $7 million as a settlement. The amount is a large part of his medical expenses as well as lost income and suffering and pain.
Creosote
Many chemicals are present in creosote, including dioxin, phenols, pentachlorophenol and polycyclic aromatic hydrocarbons. Long-term exposure to the gaseous components of the chemicals could cause irritation to the respiratory tract. Long-term exposure to creosote has been linked to skin cancer and an illness similar in its nature to acute myeloid leukemia.
Creosote enters your body through the lungs via air pollution through the stomach and intestines after eating food that is contaminated or drinking unclean water or coming into contact with the skin. It is absorbed quickly through the skin. The exposure can cause damage to the liver, kidneys, gastrointestinal tract and central nervous system. The toxic substance is in the eyes and may cause a variety of diseases.
Rail workers are exposed to a range of harmful chemicals at their work. If they are injured by these toxic substances, they deserve compensation from their employer. Contact our railroad injury lawyers today to discuss your case.
The small Florida town of Hull was once home to a rail company that treated wood with coal-tar creosote to protect, waterproof and insect-proof wooden railroad ties. When CSX purchased the company several years ago the chemicals spread and contaminated the land around. Residents are suing CSX for the contamination of their drinking water as well as their homes. Regan the EPA Administrator, was in the area in order to know more. Residents claim that drinking water that is contaminated near the UPRR plant is causing leukemia in children and other health problems.
Asbestos
The use of asbestos in the production of railroad materials was widespread throughout the decades. Many railroad workers were exposed asbestos dust as they worked in steam trains and around or inside repair shops. These asbestos fibers were often carried home on the hair and clothing of workers and exposed loved ones to the harmful substance.
Despite the dangers that come with asbestos exposure railroad companies have either dismissed or denied the dangers for many years. In the end, many railroad workers who received an asbestos cancer diagnosis later in life did not receive sufficient compensation from their employers.
Due to their complexity, asbestos lawsuits differ from other workers' comp claims. Railroad workers could be able to claim compensation under the Federal Employers' Liability Act (FELA). FELA is a different way to traditional laws governing workers' compensation. Railroad workers who have been diagnosed with an asbestos-related illness may file a claim under FELA provided that they can prove their employer's negligence was the cause of their injury.
Plaintiffs in the case claim that the railroad contaminated Fifth Ward with dangerous chemicals and did not do anything to clean the area. Residents of the area at the time of the contamination have suffered from a variety of health issues including throat and lung cancer as well as asthma and other respiratory diseases. They also suffered from the loss in property value because of the contamination.
Lead
Those who work on railroads are exposed to a variety of carcinogenic substances, chemicals, and fumes. These toxic chemicals are known to cause leukemia as well as other fatal illnesses among employees. Many of these exposures are a result of railroad negligence.
Railroad workers are often exposed to welding fumes, diesel exhaust asbestos, silica, and asbestos among other toxins. These exposures can result in a myriad of long-term health problems including lung cancer, bladder cancer, esophageal carcinoma, kidney cancer and other forms of leukemia.
The most common cause of leukemia and other blood and bone marrow diseases is exposure to benzene. It is a colorless, flammable liquid that has the ability to evaporate into the air. It is employed in many industrial processes and it can be found in small amounts in the air. The chemical is also present in gasoline and a variety of other products. The exposure to benzene, particularly when inhaled or consumed, can cause serious health problems.
