Ten Stereotypes About Railroad Lawsuit Chronic Lymphocytic Leukemia That Aren't Always True
railroad lawsuit Caused by Railroad Work

Under FELA railroad workers can claim compensation for injuries. To succeed in bringing a claim, the injured person must prove that negligence on the part of railroad workers played a role in causing their injury.

The evidence presented at the trial included the testimony from an toxicologist who used a variety of studies and relative risks to prove that Harris's multiple myeloma was the result of his exposure diesel exhaust.

Benzene Exposure

Benzene is linked to a number of hematopoietic tumors, including Acute Myeloid Leukemia(AML), Acute Non-Lymphocytic Leukemia(ANLL) and Multiple Myeloma. According to the International Agency for Research on Cancer, the chemical benzene belongs to the Group 1 Carcinogen. The chemical is present in diesel fumes and railroad workers are exposed to it.

Railroad workers may also be exposed to cleaning products like Safety-Kleen or CRC. These cleaning products typically contain a particular type of benzene known as the methylbenzene. The methylbenzene can be converted into a chemical known as dioxin when it comes into contact with water. Dioxins can cause lung cancer as well as other serious health problems.

Parker Waichman has represented railroad employees in personal injury lawsuits against their employers under the FELA. A jury gave $7.5 million to an ex Chicago and North Western Railroad employee diagnosed with acute myeloid carcinoma after years of exposure.

Another case involved a plaintiff diagnosed with myeloma after working as an engineer of railroad signal maintenance for several years. He claimed his condition was caused by exposure to diesel exhaust and benzene that he was exposed to working. BNSF filed a summary judgment motion before the trial began, based on the idea that plaintiff knew or should have known that his cancer was a result of exposure to environmental hazards and chemicals when working for the railroad.

Creosote Exposure

A poisonous chemical that is that is used as a wood preserver creosote is linked to various cancers including scrotal and skin cancer. This substance is often a issue for railroad workers working on the maintenance and repairs of railway ties. The National Toxicology Program has reported that workers who handle creosote are at a greater risk of developing lethal cancer than the general population.

A recent court case in which a railroad employee who was diagnosed with multiple myeloma. The case alleged that the exposure to diesel exhaust and other environmental toxins caused the cancer. The judge decided that the plaintiff was aware of the potential dangers posed by his work in the railroad and might have discovered his injuries through a reasonably thorough internet search at the time he was diagnosed. He was not able to undertake the search and the case has been deemed time-barred.

In a separate case, the railroad was able to win a defense decision in a suit filed in Philadelphia County by a former railroad worker. The plaintiff claimed that the cause of his illness was bladder cancer due to his occupational exposure to smoke and other chemicals such as diesel exhaust, and creosote.

Parker Waichman has also secured defense verdicts in the cases involving other types of cancers including lung and prostate cancer, which was brought by former railroad employees who claimed that their cancers stemmed from years of exposure to toxic chemicals at work. The firm is prepared to review the facts of your case and explain your options.

Asbestos Exposure

Railroad employees may be exposed to asbestos while working. Workers are exposed to asbestos when they work with railroad ties, fix or install railway equipment or work on railroad railway ties. Asbestos exposure can result in mesothelioma or lung cancer and other diseases.

In Multiple myeloma lawsuit filed against CSX Transportation, plaintiff Ronald K. Harris claims that he contracted multiple myeloma as a consequence of his work for the railroad. According to the lawsuit, Harris worked for CSX Transportation at its Laredo rail yard on a daily basis. Harris breathed "harmful and toxic fumes, chemicals, and agents including but not limited to diesel exhaust, welding fumes and creosote.

We successfully represented our clients at a jury trial lasting two weeks. It was claimed that the repetitive bending and lifting while working as trackmen caused herniated discs in the lumbar area and permanent disability of 25% which resulted in a loss of wage and discomfort and pain. Kidney cancer lawsuit was not found to be negligent, and the plaintiff was awarded a small award.

Environmental Exposure

Railroad workers are exposed to a number of different environmental chemicals. Based on the type of work that is performed and the type of work, exposure to chemicals can lead to numerous health problems, including multiple myeloma. Contact Parker Waichman if you or a family member has been diagnosed with myeloma due to working on railroads.

In a recent trial a railroad employee was awarded $7.5 million by a juror for being diagnosed with acute myeloid leukemia and myelodysplastic Symptom (MDS). He sued two major railways for claiming that exposure to diesel exhaust and asbestos caused health issues.

The railroads filed a motion for summary judgment in which they claimed that at the time of the plaintiff's diagnosis the plaintiff was aware of all the details and causes of the injury. The court agreed with the railroads and granted their motion, concluding that the plaintiff had not conducted a reasonable investigation to determine if the condition was connected to his work at the railroad.

At trial, the plaintiff presented expert testimony from an industrial hygienist and epidemiologists. Expert witnesses stated that Harris's myeloma may be the result of his exposure to diesel exhaust. In support of this claim the expert witness cited several studies that proved that there was a link between certain kinds of cancers and diesel exhaust. But, no reputable scientist has ever concluded that diesel exhaust is the cause of multiple myeloma.
