Railroad Settlement Allowed
A settlement agreed to after what has been described as marathon negotiations ended a rail strike on Friday. The agreement provides workers with an increase of 24% over five years, as well as an additional personal day. The agreement also alters strict guidelines for attendance to allow the absence of employees due to illness.
The agreement does not offer paid sick days. This is a major concern for many railroad workers. This could force unions to oppose arbitration, which would initiate a 30-day cooling-off period.
Land Grants
Railroad companies utilized the land granted to them by the federal and state governments to lower the cost of building their lines. They could then use this asset to secure mortgage loans or sell bonds in future. It also helped them draw settlers to the area in which their lines would travel which boosted the demand for their services.
Although there were many problems with land grants, like corruption and misuse of the system, overall, they helped to make the United States prosper by creating an infrastructure for transportation that opened up the West for settlement. The railways supported programs for improving agriculture, which encouraged farmers to succeed and created more need for railroad transportation.
The federal government hoped to promote the construction of a transcontinental railroad by providing large grants of land to private corporations. The federal government offered 130 million acres to the first five companies that constructed a transcontinental railway, and states contributed 50 million acres.
In order to obtain the land grants, the railroads had to give up their rights to the land that they had acquired in aid of construction or as indemnity. These rights were generally dependent on natural features, such as rivers and streams however in some instances the boundary was marked with the use of pointers. Railroads were also allowed to select other public land in lieu of the grant lands.
Contracts
Rail transport is an essential aspect of the economy and requires a high degree of reliability to keep the freight moving. A major rail strike could have stopped shipments and imposed significant costs on customers. With a total of $27 billion net income, railroads can afford to take a hit to their revenue streams from passive sources and offer workers paid leave and better working conditions. They just don't want to.
This year the unions and railroad executives broke down over issues such as worker benefits and work regulations. The two largest freight rail labor unions, the Brotherhood of Locomotive Engineers and Trainmen and SMART-TD were unable to approve the proposal for a contract that included 24% wage increases and changes to the railroad's attendance policies that some view as draconian.
The unions would prefer to negotiate a deal on their own but this option was not offered to them. They urged the National Mediation Board instead to declare an impasse and move to arbitration. However, that strategy, as exemplified by the recent vote for strike action, has moved negotiations into political territory. Congress is now preparing to impose a compromise agreement to avoid a rail shutdown. The bill would bind workers and companies to a deal that is labor-friendly Obama White House brokered.
Disputes
Under the Railway Labor Act, Congress and the President are able to intervene in labor disputes in the transportation industry to prevent strikes and lockouts which impede commerce across the nation. It's rare that they decide to take action directly on disputes. Joe Biden did exactly that today. He signed a bill to bind railroad companies and workers to the proposed agreement reached between the two sides. He declared that it was the right decision due to the risk of an economic disaster that would strike at a time when the country's already struggling economy.
The agreement that is subject to ratification by the workers, includes an increase of 24% in pay over five years, along with medical leave and caps on healthcare expenses. It also includes changes to railroads' strict attendance policies, allowing employees to take time off for medical reasons and not be disciplined. Nearly all progressives in the House, including Alexandria Ocasio Cortez, Mark Pocan and Ilhan Omar as well as Pramila Jayapal, voted in favor of the settlement.
The agreement isn't quite enough of meeting a few union demands, notably the demand for paid sick days. The railroads evidently wanted to avoid having to face an angry Congress. Mr. Harris, head of the union representing switchmen, was in agreement that the idea should be discussed. The mediators, after making it clear that they would only offer recommendations if both parties suggested them, accepted the proposal of the unions.
Settlements
