Dank voor uw e-mail. Hoeveel het ongeveer in totaal gaat kosten is afhankelijk van of de huurder n.a.v. de te versturen brief netjes het gehuurde verlaat. Als de huurder het gehuurde n.a.v. de brief verlaat dan zullen enkel de kosten voor het opstellen van de brief en de verdere correspondentie bij u in rekening worden gebracht. Voor het opstellen van de brief verwacht ik 1 uur nodig te hebben. De verdere correspondentie is afhankelijk van de hoeveelheid correspondentie (met de huurder en met u). Mocht de huurder naar aanleiding van de brief het gehuurde niet verlaten, dan zal er een kort geding opgestart moeten worden. De ureninschatting (exclusief griffierechten) voor een kort geding is als volgt:
Opstellen dagvaarding 7 uur
Voorbereiden mondelinge behandeling 2 uur
Mondelinge behandeling 2 uur
Nabespreken mondelinge behandeling 1 uur
Correspondentie met rechtbank 0,5 uur
Vonnis bespreken met cliënt 0,5 uur
Totaal: 13 uur (€ 4.752,03)
De juridische kosten zullen dan in zijn geheel door de notaris aan Brugrecht Advocaten voldaan moeten worden. Ik kan u helaas geen zekerheid geven dat de vordering door de rechter toegewezen zal worden. Het is altijd aan de rechter om dit te beoordelen. Indien de rechter de huurder niet veroordeelt om het gehuurde te verlaten en u de woning dus niet zonder huurders aan de koper kunt leveren, dan is er geen mogelijkheid om de boete die de koper dan bij u in rekening zal brengen, bij de huurder in rekening te brengen.
