The lawyers for the railroad are arguing that these rules are designed to safeguard workers and the public from injuries as well as environmental damage caused by accidents or derailments. Doi claimed that Union Pacific was negligent in numerous ways, including the failure to supervise and train its employees properly. Doi also claimed that the railroad was unable to ensure proper safety practices and that it failed to adhere to industry standards. The jury awarded the plaintiff $557 million in damages.

A part of the award of $557 million will also be used to fund his future medical care. The court will also issue an order requiring the railroad to take actions to ensure that the members of the zone are properly trained and equipped with the proper safety equipment and procedures to operate their vehicles.

Hallman who was Torres's legal counsel, sought the court's approval of the settlement in accordance with Code of Civil Procedure fn. 1 section 877.6 which states that courts must approve settlements that are made in good faith. The workers are just a tiny portion of the more than 30,000. However, their claims could prove costly to the railroad.

She also received a substantial amount of money to help with her suffering and pain, and medical bills and income loss. She is no longer able to work as she's been diagnosed with severe brain damage and amputation of her leg.

According to the plaintiffs, Union Pacific knew about the defect in its track detector circuitry 10 months before the collision but failed to correct it. The defect caused the warning lights and bells to be delayed, which contributed to the crash.

Furthermore, the plaintiffs claim that the railroad company should have provided more education to its employees in order to prevent incidents like this. They also insist that the company pay a $3.5million civil penalty.

Another settlement was reached in the case of a patient who was diagnosed with kidney damage due to doctors misdiagnosed her condition. The doctor did not properly conduct an MRI or perform blood tests. The doctor then operated on her without having a complete understanding of the problem with her and caused permanent kidney damage.
