Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is the first trial to be held since J&J filed for bankruptcy and split off its Talc division.

Earlier this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs attributed their cancer to asbestos found in J&J's Shower Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma, a deadly type of cancer, affects the mesothelium or the lining that surrounds organs and cavities within the body. It is most prevalent in the lungs but can be located in the abdomen and chest cavity. Asbestos is the most well-known mesothelioma causing agent, and people who have been exposed to asbestos are at a greater risk of developing this disease.

The first trial following J&J declared bankruptcy on its talcum powder division opened in Oakland, California this week. Jurors were inspired by the story of the plaintiff. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial cancer in 2022. He attributed the cause of his condition to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J is accused of hiding asbestos risks from consumers for many years. The company has a long tradition of hiding asbestos information from regulators, as well as paying for asbestos tests that produced the results they desired. These lawsuits have named several of the company's suppliers of talcum powder which include Whittaker Clark & Daniels, Imerys Talc America, and others.

Women who used talcum for feminine hygiene on sanitary pads or condoms as well as in the genital region have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than forty years that the powder could cause ovarian cancer and other diseases, but failed to warn consumers.

Symptoms of mesothelioma include abdominal pain and abdominal lumps, abdominal swelling and a persistent cough. Doctors can diagnose the disease through a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the location of their tumors, surgeons may be able remove the affected tissue. Certain patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal transplantation of tissue and cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong the duration of survival.

What Causes Mesothelioma?

Like all cancers, mesothelioma develops when a cell's DNA experiences mutations. These mutations cause uncontrolled growth of cells, which creates tumors in the tissues. Asbestos is the leading mesothelioma cause. Asbestos exposure can be found in a variety of fields which include manufacturing, mining construction, transportation and construction. Asbestos exposure usually occurs between 20 to 40 years prior to the time symptoms develop. Men are more likely to develop mesothelioma than females. It is also found most often in people between the ages of 50 and 70. average wrongful death settlements for mesothelioma of asbestos-related mesothelioma that a person develops is often determined by the location on their body they were exposed. The majority of people diagnosed with mesothelioma are diagnosed with pleural melanoma, which affects the lung. Others are diagnosed as having peritoneal mesothelioma. This type of mesothelioma affects the abdomen. Additionally, some patients are diagnosed with pericardial mesothelioma, the most rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.

Shortness of breath, fatigue, and abdominal pain are all symptoms of mesothelioma. In the last stages of mesothelioma, the tumors may grow to other areas, causing severe discomfort and discomfort. Other signs of mesothelioma are fluid in the lungs, loss of appetite difficulties eating and swallowing. Mesothelioma is a terminal disease, and can be fatal.

The talcum-powder trial in Oakland involved a person who was 24 who developed pericardial mesothelioma as a result of using J&J baby powder. His lawyers argued that the company knew that talc contained asbestos, but didn't inform consumers. They also cited a 1998 letter sent to an J&J executive revealing the possibility of asbestos in their products.

This is the latest in a series of high-dollar verdicts against J&J. In March the jury awarded $18.8 million to a woman who contracted ovarian mesothelioma from J&J's talcum powder. Last month, a jury in Missouri awarded $55 million in a different case involving the same issue. In addition, seven cases were added to the powder's MDL over the course of the month and brought the number of pending lawsuits to 37,522. The majority of these lawsuits involve women who have used J&J's talcum powder for feminine hygiene purposes.

How Can I tell if I have mesothelioma or not?

A diagnosis of mesothelioma is devastating. Patients should always seek out a specialist for the most precise diagnosis and to avoid misdiagnosis, which could lead to unnecessary treatment and spread of cancer.

A physical exam and blood sample can help to identify mesothelioma-related symptoms. These tests can be used to determine asbestos fibers in the blood or to determine the extent to which a patient's organs are functioning. The most accurate way to determine if mesothelioma has been detected is through a biopsy, in which doctors remove fluid or tissue from the affected area, and then examine the area under a microscope to search for mesothelioma cancer cells.

The type of mesothelioma that a person is suffering from also affects the prognosis of their patient. Pleural mesothelioma, that forms in the thin lining around the lungs, is the most frequent form of the disease and accounts for the majority of diagnosed cases. Peritoneal mesothelioma, a cancer that is found in the abdomen's lining, is less common. Finally, pericardial mesothelioma, an uncommon type that develops in the lining of the heart, is much less common and makes up approximately 1% of cases.

Some of the earliest symptoms include breathlessness which gets worse with time and coughing up blood. Asbestos victims may also experience fluid buildup in the chest cavity, which is called pleural effusion. The fluid can be removed from the chest cavity by inserting a needle into the affected area. In more severe cases, doctors may perform a procedure called pleurodesis to seal the space to prevent the reaccumulation in the pleura.

Getting an accurate mesothelioma diagnosis is the best way to determine the patient's treatment options and the survival rate. There are a variety of treatments available that include surgery, chemotherapy and radiation. Other options include immunotherapy. It is a type of treatment that boosts the immune system to fight mesothelioma cells and tumor-removing fields, which use the power of magnets to kill cancerous cells.

A specialist in mesothelioma can also help patients understand the various mesothelioma types, which determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their doctor their history of asbestos exposure to determine if mesothelioma is a possibility and what treatment options are available.

Mesothelioma is an extremely rare and fatal condition caused by asbestos exposure is a rare condition. Asbestos was a time when it was widely used in a wide range of industrial and consumer products including baby powder. In talcum-powder lawsuits, plaintiffs claim that exposure to asbestos from inhaling the powder caused them to develop mesothelioma and other health issues.

J&J allegedly knew about the risk of asbestos and talcum powder for a long time, but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking compensatory and punitive damages. The claims have been amalgamated into federal and state multidistrict litigations or MDLs.

In 2018 one of the largest Talc trials ended in an $4.7 billion settlement for the plaintiff. This was a major news story that set the stage for the rest. In the last month, a judge denied J&J's request to dismiss the lawsuits filed by the state.

J&J however, tried again to stall the litigation. The company established a new subsidiary entity to take over its talc liabilities, and LTL Management filed for bankruptcy. The bankruptcy stopped thousands of talc lawsuits but the 3rd Circuit rejected this strategy.

The lawsuits brought by the state of Mississippi are based on the same allegations as the individual lawsuits filed against J&J which allege that the company's inability to warn about the risks of ovarian cancer from the talcum powder was negligent and constituted violations of the law of the state.

J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June to determine if the lawsuits against J&J can be pursued.
