Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma trial is the first to proceed since J&J spun off its talc business and filed for bankruptcy.

This year, juries awards in New Jersey and California led to massive settlements in talc lawsuits. Plaintiffs have linked cancer to asbestos in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a lethal type of cancer, affects the mesothelium or lining around organs and cavities inside the body. It is most prevalent in the lungs, but can be found in the abdomen and chest cavity. Asbestos is the sole known cause of mesothelioma, and people who have been exposed to asbestos are at a higher chance of developing the disease.

The first trial after J&J declared bankruptcy on its talcum-powder division opened in Oakland, California this week. Jurors were inspired by the story of the plaintiff. In 2022, the plaintiff who was only 24 years old at the time, was diagnosed with malignant mesothelioma in the pericardium. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $26 million.

J&J has been accused of concealing asbestos risks from consumers since many years. The company has a long tradition of keeping asbestos information from regulators, and paying for asbestos tests that produced the results they wanted. Several of the company's talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Many women who used talcum powder for feminine hygiene in the genital area or on sanitary napkins or condoms have gotten an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits claim that J&J knew for more than 40 years that using the powder led to mesothelioma and ovarian cancer however, they failed to warn consumers of this risk.

Mesothelioma symptoms may include breathing problems, chronic coughing fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can diagnose mesothelioma by a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

Once a mesothelioma diagnosis is confirmed, patients may undergo surgery, chemotherapy and/or radiation. Depending on the location of their tumors surgeons may be able to remove the affected tissue. Patients with mesothelioma may have a life expectancy lower than five. However aggressive treatments like extracorporeal transplantation of tissue and chemotherapy for cytoreduction that uses hyperthermic intraperitoneal therapy can prolong survival.

What causes Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA changes within a cell. These mutations cause the cells to multiply in uncontrolled ways, forming tumors in the tissues of the body. Asbestos is the leading mesothelioma cause. Asbestos exposure can occur in a variety of industries such as manufacturing, mining and transportation. asbestos cancer lawsuit lawyer mesothelioma is typically exposed between 20 and 40 years before symptoms developing. Mesothelioma affects men more than women, and it is usually diagnosed in people in their 50s and 70s. The type of asbestos-related mesothelioma that a person develops is often determined by the place on their body they were exposed. The majority of patients diagnosed with pleural mesothelioma that affects the lung. Others are diagnosed with peritoneal melanoma, a type of mesothelioma that affects the abdomen. In addition, some individuals are diagnosed with pericardial melanoma, an extremely rare type of the disease that affects the heart's lining (pericardium) and the organ itself.

Insomnia as well as abdominal pain and fatigue are all symptoms of mesothelioma. In the later stages of mesothelioma, the tumors can expand to other parts of the body which can cause extreme discomfort and discomfort. Other symptoms that are common to mesothelioma include fluid on the lung (pleural effusion), loss of appetite, difficulty swallowing and a blockage in the small intestine referred to as a obstruction in the bowel. Mesothelioma can be fatal.

The talcum-powder case in Oakland involved a person who was 24 years old who was diagnosed with pericardial msothelioma after using J&J baby powder. His lawyers argued that the company knew that talc might contain asbestos, but didn't inform consumers. They also cited a letter in 1998 to an J&J executive that highlighted the possibility of asbestos in their products.

This is the latest in a string of major verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. In March, a jury in Missouri awarded $55 million in the same case. In addition, seven new cases were added to the powder's MDL over the last month, bringing the number of lawsuits pending to 37,522. The majority of these lawsuits involve women who used J&J's talcum powder for feminine hygiene reasons.

How Can I tell if I have mesothelioma or not?

A diagnosis of mesothelioma is devastating. Patients should always seek out a specialist to ensure the most accurate diagnosis and to avoid mistakes that could lead to unneeded treatment and the spread of cancer.

A physical examination and a blood test can be an excellent way to determine whether mesothelioma has caused symptoms. These tests can be used to determine the presence of asbestos fibers in the blood or to determine the extent to which a patient's organs are functioning. The most accurate method of diagnosing mesothelioma is taking a biopsy. Doctors extract tissues or fluids from an affected area, and then look at them under a microscope for mesothelioma cancer cells.

The type of mesothelioma a person has can also influence the prognosis of a patient. Pleural mesothelioma is by far the most common type of the disease and is responsible for the majority of cases that are diagnosed. Peritoneal cancer that develops in the lining surrounding the abdomen is a less prevalent type. The pericardial mesothelioma, a rare type of cancer that develops in the lining of the heart, is much less common and makes up around one percent of cases.

The first signs include shortness of breath which gets worse with time and a coughing up of blood. Asbestos patients may also experience fluid buildup in the chest cavity, which is known as pleural effusion. It can be eliminated by inserting a needle in the affected region of the chest cavity. In more serious cases, doctors can use a procedure known as pleurodesis, which seals the area to prevent the reaccumulation in the pleura.

A reliable diagnosis of mesothelioma is essential to determining the patient's survival rate as well as treatment options. Treatment options include chemotherapy, surgery and radiation are all options. Other options include immunotherapy. It is a form of treatment that enhances the immune system to fight mesothelioma cancer cells, and tumor treating fields, which employ a magnetic field to eliminate cancerous cells.

A specialist in mesothelioma can also help patients understand the different mesothelioma cell types which determine how invasive the cancer is and what the patient's prognosis is. Patients should discuss with their doctor their history of asbestos exposure to determine whether mesothelioma is possible and what treatment options are available.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos was once widely used in a range of consumer and industrial products, including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder led to asbestos exposure and subsequently mesothelioma and various other health issues.

J&J believed to have known about the dangers of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against J&J seeking compensatory and punitive damages. These claims have been consolidated in federal and state multidistrict lawsuits, or MDLs.

In 2018 one of the biggest Talc cases resulted in a $4.7 billion verdict in favor of the plaintiff. This made national headlines and set the tone for the remainder of the litigation. Last month, a judge denied a request by J&J to dismiss the lawsuits brought by the state of Mississippi.

J&J, however, tried again to stall the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company created an entity that would take on its liabilities. The bankruptcy ended thousands of talc suits, however, the 3rd Circuit rejected that strategy.

The lawsuits brought by the state of Mississippi are built on the same allegations that were a part of the individual lawsuits filed against J&J which allege that the company's inability to warn about the risks of ovarian cancer from talcum powder was negligent, and violated state law.

J&J has resubmitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June to determine if the lawsuits against J&J will be allowed to continue. If you or someone you know has been diagnosed with a mesothelioma or another condition that could be caused by talcum powder you should seek legal assistance immediately. Our experienced lawyers will assist you in getting the compensation you're entitled to.
