Why Mesothelioma Talc Lawsuit Could Be A Lot More Hazardous Than You Thought
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old man with mesothelioma pericardial has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case marks the first trial to be held since J&J filed for bankruptcy and split off its talc division.

Earlier this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs attributed cancer to asbestos found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

mesothelioma lawsuit settlement amounts , which is a fatal type of cancer, affects the mesothelium or the lining surrounding organs and cavities within the body. It is most commonly found in the lungs, however it can also occur in the abdomen, the heart and chest cavity as well as testicles. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed to asbestos are at a higher chance of developing it.

The first trial since J&J declared its talcum powder division bankrupt opened this week, and jurors in Oakland, California were emotional as they heard the testimony of the plaintiff. In 2022, the plaintiff who was only 24 years old at the time was diagnosed with malignant mesothelioma of the pericardium. He attributed the cause of his illness to his use of Johnson & Johnson Baby Powder. The jury awarded him $25 million.

J&J has been accused of concealing asbestos risks from the public for a number of years. The company has a long track record of concealing asbestos-related information from regulators, and paying for asbestos tests that did not yield the results they desired. Some of the company's Talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Women who used talcum to provide feminine hygiene, such as sanitary pads or condoms as well as in the genital region have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than 40 years that the powder could cause ovarian cancer and other illnesses, but did not take the time to warn consumers.

Mesothelioma symptoms include abdominal pain as well as abdominal swelling, abdominal lumps, and persistent coughing. Doctors can diagnose mesothelioma by physical examination and imaging scans. These could include CT (computer tomography) scans, MRIs and PET or X-rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the location of their tumors, surgeons may be able remove the affected tissue. Patients with mesothelioma may be given an expected life expectancy of less than five years. However, aggressive treatments like extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy can extend the life expectancy.

What Causes Mesothelioma?

Like most cancers, mesothelioma develops when a cell's DNA experiences mutations. These mutations lead to uncontrolled growth of cells, which forms tumors in tissues. Asbestos is the most frequent cause of mesothelioma. Exposure to asbestos can be found in many different industries such as mining, manufacturing construction, and transportation. Asbestos exposure usually occurs between in the 20 to 40 years preceding symptoms appear. Men are more likely to develop mesothelioma compared to women. It is also found most often among those between the ages of 50 and 70. The type of asbestos-related mesothelioma that someone develops is often determined by where they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma which affects the lungs. Others are diagnosed with peritoneal mesothelioma. one type of mesothelioma which affects the abdomen. Some people are diagnosed with pericardial msothelioma. This is an extremely rare form of cancer that affects both the inner lining (pericardium) and the organ itself.

Symptoms of mesothelioma include fatigue, breathlessness abdominal pain and weight loss. In the latter stages of mesothelioma the tumors can spread to other parts, causing severe discomfort and pain. Other common symptoms of mesothelioma include swelling of the lung (pleural effusion), loss of appetite, difficulties swallowing and a blockage in the small intestine called a bowel obstruction. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved an individual of 24 who developed pericardial mesothelioma as a result of using J&J baby powder. His lawyers argued that J&J knew that talc was contaminated with asbestos, but didn't warn customers. They also cited an 1998 letter addressed to a J&J executive, revealing the possibility of asbestos being in their products.

This is only the latest in a long line of high-dollar verdicts against J&J. In March the jury handed down $18.8 million to a woman who was diagnosed with mesothelioma ovarian from J&J's talcum powder. Then, last month the jury in Missouri awarded $55 million in a different case that dealt with the same issue. Seven new cases have been added to the MDL talcum powder over the last month, bringing to 37,522 the number of lawsuits pending. The majority of these lawsuits concern women who have used J&J's talcum powder for feminine hygiene purposes.

How do I know If I Have Mesothelioma?

A diagnosis of mesothelioma could be devastating. Patients should always seek out a specialist for the most accurate diagnosis and to prevent misdiagnosis, which could lead to unnecessary treatment and spread of cancer.

A physical exam and blood sample can help identify mesothelioma symptoms. These tests can check for the presence of asbestos fibers in the blood or to assess how well a patient's organs are functioning. The most reliable method to determine if mesothelioma has been detected is through a biopsy, where doctors remove tissue or fluid from the affected area, and then examine it under a microscope to look for mesothelioma cells.

The type of mesothelioma that a sufferer has also impacts the prognosis of their patient. Pleural mesothelioma, that forms in the thin lining of the lungs, is the common form of the disease and accounts for the majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that forms in the lining of the abdomen is less prevalent. The pericardial msothelioma, in turn, is a rare form of cancer that occurs in the lining the heart. It is only one percent of all cases.

Shortness of breath, which is more severe with time, and bloody coughing are a few of the initial symptoms. Asbestos victims may also experience fluid buildup in the chest cavity, which is known as pleural effusion. This can be drained by inserting a needle in the affected region of the chest cavity. In more serious cases, doctors can perform a procedure called pleurodesis to seal the space to prevent the reaccumulation in the pleura.

A precise mesothelioma diagnosis is the best method to determine a patient's treatment options as well as their survival rate. Chemotherapy, surgery and radiation are all options. There are also immunotherapy treatments that boosts the immune systems to fight mesothelioma as well as cancer treating fields that employ magnetic fields to kill cancerous cells.

A mesothelioma specialist may also assist patients in understanding different mesothelioma types that determine the extent of the cancer and the outlook of the patient. Patients should discuss their history of exposure to asbestos with their physician to determine if they're a mesothelioma candidate and discover what kinds of treatment options are available to them.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos used to be widely used in a variety of industrial and consumer products, including baby powder. Plaintiffs in talcum powder lawsuits claim that inhaling talcum powder caused to their asbestos exposure, which contributed to mesothelioma and various other health issues.

J&J believed to have known about the dangers of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against J&J seeking punitive and compensatory damages. These lawsuits have been combined into federal and state multidistrict litigations, also known as MDLs.

In 2018, one of the largest talc cases led to a $4.7 billion verdict in favor of the plaintiff. The news made headlines across the country and set a tone for the rest of the litigation. In the last month, a judge denied J&J's request to dismiss the lawsuits filed by the state.

However, in an effort to halt the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J, filed for bankruptcy after the company established an entity to take over its obligations. The bankruptcy stopped the talc lawsuits of thousands, however, the 3rd Circuit rejected this strategy.

The lawsuits filed by Mississippi are based on the same allegations of the individual lawsuits brought against J&J. They allege that the company was negligent in failing to warn of the possibility of ovarian cancer from talcum powder and that this was a violation of state law.

J&J has submitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing has been scheduled for June to decide whether the lawsuits against J&J will be allowed to proceed.
