Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is to blame for his cancer. The Oakland mesothelioma case marks the first trial that has been held since J&J filed for bankruptcy and spun off its Talc division.

Earlier this year, jury awards in New Jersey and California led to massive settlements in talc lawsuits. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Shower and Baby Powder products.

What is Mesothelioma?

Mesothelioma is a fatal form of cancer that affects the mesothelium, or lining that surrounds organs and body cavities. It is most common in the lungs, but can also be found in the abdomen and chest cavity. Asbestos, the sole known cause of this illness, is asbestos. People who have been exposed to asbestos are at a higher risk of developing it.

The first trial since J&J declared bankruptcy over its talcum powder division opened in Oakland, California this week. Jurors were inspired by the story of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial cancer in 2022. He blamed the cause of his illness to his use of Johnson & Johnson Baby Powder. The jury awarded him $25 million.

J&J has been accused of concealing asbestos risks from consumers since many years. The company has a long history of concealing asbestos-related information from regulators, and paying for asbestos tests that produced the results they wanted. The lawsuits have identified a number of the company's suppliers of talcum powder, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.

Many women who used talcum powder to maintain feminine hygiene in the genital region or on sanitary napkins or condoms have been diagnosed with an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than 40 years that the powder could cause ovarian cancer as well as other diseases, but failed to warn consumers.

mesothelioma lawsuit settlements of mesothelioma include abdominal pain as well as abdominal swelling, abdominal lumps and persistent coughing. Doctors can diagnose mesothelioma through a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery and/or radiation. The surgeons are able to remove the affected tissue depending on the location of the tumors. Certain patients with mesothelioma have a life expectancy lower than five. However aggressive treatments like extracorporeal tissue transplantation and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the life of patients.

What causes Mesothelioma?

Like most cancers, mesothelioma is caused when a cell's DNA experiences mutations. The mutations cause the cells to multiply uncontrollably and develop tumors in tissues of the body. Asbestos is the most common cause mesothelioma. Asbestos exposure is common in many different industries including mining, manufacturing and transportation. Asbestos exposure is typically seen 20 to 40 years before symptoms begin to manifest. Mesothelioma is more prevalent in men than women, and is usually diagnosed in people who are in their 50s to 70s. The kind of mesothelioma caused by asbestos that someone develops is often determined by where on their body they were exposed. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma, which affects the lungs. Some are diagnosed with peritoneal mesothelioma. This kind of mesothelioma affects the abdomen. Additionally, some patients are diagnosed with pericardial mesothelioma, an extremely rare type of the disease that affects the lining of the heart (pericardium) and the organ itself.

A lack of breath, fatigue and abdominal pain are all signs of mesothelioma. In the last stages of mesothelioma, tumors can spread to other parts, causing severe discomfort and discomfort. Other symptoms that are common to mesothelioma include fluid on the lung (pleural effusion) and a loss of appetite, difficulty swallowing and a blockage within the small intestine, referred to as a obstruction of the bowel. Mesothelioma is a debilitating illness that is usually fatal.

The talcum-powder case in Oakland involved an individual of 24 who developed pericardial msothelioma following the use of J&J baby powder. His lawyers argued the company knew that talc was contaminated with asbestos, but didn't warn customers. They also cited an 1998 letter addressed to an J&J executive that revealed the possibility of asbestos being present in their products.

This is just the latest in a long line of major verdicts against J&J. In March, a jury handed down $18.8 million to a woman who was diagnosed with ovarian mesothelioma from J&J's talcum powder. Last month, a jury in Missouri awarded $55 million in another case that dealt with the same issue. In addition, seven new cases were added to the powder talcum MDL over the course of the month which brought the number of pending lawsuits to 37,522. Most of these lawsuits were filed by women who used J&J talcum powder to maintain their feminine hygiene.

How Can I Tell if I Have Mesothelioma?

A diagnosis of mesothelioma is devastating. Patients should always consult a specialist to get the most accurate diagnosis and to prevent misdiagnosis, which could lead to unneeded treatment and spread of cancer.

A physical exam and blood sample can aid in identifying mesothelioma symptoms. These tests can be used to test for asbestos fibers in blood, or the health of the patient's internal organs. The most precise method to determine if mesothelioma has been detected is through a biopsy, where doctors remove fluid or tissue from the affected area and then examine it under a microscope in order to look for mesothelioma cells.

The type of mesothelioma that is present in a patient can influence the prognosis of a patient. Pleural mesothelioma that develops in the thin lining of the lung, is the most common form of the disease and accounts for the vast majority of diagnosed cases. Peritoneal mesothelioma is a type of cancer that is found in the lining of the abdomen, is less common. In addition, pericardial mesothelioma is a rare type that occurs in the lining the heart. It only accounts for one percent of all cases.

Some of the first symptoms include a shortness of breath that gets worse over time and a coughing up of blood. Asbestos patients can also experience fluid accumulation within the chest cavity. This is known as pleural effusion. The fluid can be eliminated from the chest cavity by inserting a needle into the affected region. In more serious cases, doctors may perform pleurodesis, which is a procedure that seals the space to prevent the fluid from accumulating within the pleura.

A precise mesothelioma diagnosis is the best method to determine the patient's treatment options and survival rate. There are many treatments available, including surgery, chemotherapy and radiation. There are also immunotherapy treatments that boosts the immune systems to fight mesothelioma and tumor treating fields that use magnetic fields to kill cancerous cells.

A mesothelioma specialist may also help patients understand different mesothelioma cells that determine the extent of the cancer and the outlook for patients. Patients should discuss with their doctor their history of asbestos exposure to determine if mesothelioma is possible and what treatment options are available.

Mesothelioma is a rare, but fatal disease caused by exposure to asbestos. Asbestos was used in a variety of industrial and consumer products like baby powder. In talcum-powder lawsuits plaintiffs claim that exposure to asbestos from inhaling the powder caused them to develop mesothelioma and other health issues.

J&J allegedly knew about the dangers of talcum powder and asbestos for a long time, but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against J&J seeking punitive and compensatory damages. The claims have been combined into federal and state multidistrict litigations, also known as MDLs.

In 2018 one of the first large trial involving talc resulted in an $4.7 billion settlement for the plaintiff. This was a national news story that set the tone for the rest. Last month, a court denied J&J's motion to dismiss the lawsuits brought by the state.

J&J however, attempted to stop the litigation. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company created a new entity to assume its liabilities. The bankruptcy stopped the talc lawsuits of thousands, but the 3rd Circuit rejected this strategy.

The lawsuits filed by Mississippi are based upon the same allegations of the individual lawsuits brought against J&J. They assert that the company was negligent in failing to warn of the possibility of ovarian carcinoma from talcum-powder and that this resulted in an infraction to the law of the state.

J&J has resubmitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J are able to continue.
