5 Laws Anyone Working In Asbestos Lawsuit History Should Be Aware Of
Texas Asbestos Lawsuit History

Many companies have gone bankrupt due to asbestos lawsuits filed by the victims. A mesothelioma attorney can assist you in getting compensation.

Experts in the health field have warned for years about the dangers asbestos exposure. But, some industry leaders minimized the risks. Over time increasing numbers of people were diagnosed with asbestos-related illnesses.

The Third Case

Asbestos litigation really took off in the 1970s after research studies began to link asbestos to severe diseases like asbestosis and mesothelioma. Tens of thousands of lawsuits were filed because these diseases don't usually exhibit symptoms until decades after exposure. These lawsuits were filed in Texas because of its favorable laws.

One of the most important cases that shaped asbestos litigation involved Johns Manville, the leading producer of asbestos products in the 1940s and 1950s. In the 1980s, it was brought to be known that the company's chief executive Lewis Brown prioritized company profits over the health of his employees. In his deposition testimony Brown admitted to being heavily affected by Dr. Russell Budd, the chief medical advisor of his company. Budd was a doctor well-known for his callous disregard of the health of workers.

The evidence showed that Johns Manville knew about the asbestos dangers but did nothing to safeguard its workers. The court found that the company is responsible for any damages that occur if employees later develop mesothelioma, or any other asbestos-related illness. The court also determined that the company was responsible for the families of deceased workers.

After the decision in Borel, many asbestos victims and their families sought compensation from companies that used asbestos. Unfortunately, the majority of claims were dismissed for various reasons. Some cases were permitted to proceed and the courts came up with guidelines that guide the handling of asbestos-related lawsuits.

In the 1990s asbestos defendants were seeking legal rulings to restrict their liability. For example they wanted to be able to argue that the asbestos materials were not part of their product and therefore could not be held responsible for injuries suffered by those who worked with them. asbestos lawsuit attorney were not successful, and the U.S. Supreme Court refused to recognize the "asbestos product" defense.

Today, a mesothelioma victim's right to seek compensation from the parties responsible in a case is protected under federal and state law. Insurance companies continue to fight against these claims.
