The Ultimate Cheat Sheet On Mesothelioma Compensation Royal Navy
Mesothelioma Compensation and the Royal Navy

On 16 December 2015, the Ministry of Defence changed their policy to allow service personnel diagnosed with mesothelioma the option of choosing whether to receive a lump sum or traditional war pension. But the decision was not applicable to all veterans who had already been diagnosed with mesothelioma.

This includes Rhod Palmer and Fred Minall, who were exposed to asbestos during their military service as well as civilian jobs. This was a great injustice to them and their families.

The law has changed

Mesothelioma is a severe form of cancer that is caused by exposure to asbestos. It can take years for symptoms to manifest and once diagnosed, most sufferers have a life expectancy of only one or two years.

The Government's decision to change the law is a significant step forward. From April 2016, armed forces veterans diagnosed with mesothelioma can choose select whether to receive their pension or receive a lump sum amounting to PS140,000. This is a much more substantial amount than the typical civil award.

Prior to the changes, veterans of the armed forces diagnosed with mesothelioma had access to an War Disablement Pension. This only provided an income per month that was not appropriate for those suffering from severe long-term illnesses such as mesothelioma. In addition, it was not possible to obtain lump sum compensation under the War Pension Scheme.

After intense lobbying, and aided by the Royal British Legion, Asbestos Victims Support Group Forum and the Royal British Legion, the law was changed to allow veterans of the armed forces that have been diagnosed with mesothelioma to receive an amount of lump sums up to PS140,000, in addition to the traditional War Pension. The lump sum will also be tax-free.

Prior to this, mesothelioma patients would have been eligible for an income from wartime disability of up to PS32,000 in the event that the person was single divorced, widowed or divorced. Civilians who have mesothelioma, however could receive as much as PS600,000.000 under the government's Diffuse Mesothelioma program.

The new law will apply to all veterans of the armed forces diagnosed with mesothelioma who want to take up this option. It will also be available to those who were exposed to asbestos during their time in the armed forces and also outside of it, known as "dual exposure".

Mesothelioma UK is already helping former soldiers, sailors and other service members with their mesothelioma claim. We can help them learn about the new law and what's involved. We can also assist them in determining the best way to receive compensation. This can include tracing the companies that may be responsible for their exposure to asbestos.

The lump amount will be PS140,000.

The amount of compensation paid to patients is determined by several factors, like age, the impact mesothelioma has on the lifespan and the level of care needed. It also takes into account the impact mesothelioma has caused on family members as well as whether or not the person is able to continue working.

Asbestos victims must seek compensation from the people responsible for their exposure to asbestos. For those who are unable to find those responsible, a government scheme pays lump sums to those suffering of mesothelioma. The average amount is around PS144,000.

In the past, ex-servicemen who were diagnosed with mesothelioma would only be eligible for a war-related disability pension under the Diffuse Mesothelioma Scheme 2008. It is a monthly sum determined by the individual's age and the severity of their disability. However, it is much less than mesothelioma compensation for civilians, which can reach six-figures.

Fred Minall from Northampton who was a member of the Royal Navy as a naval engineering between 1957 and 1964 has been informed that he is entitled to a lump sum payment of PS140,000, as per the new law. He has mesothelioma - an incurable lung disease caused by exposure to asbestos.

According to mesothelioma attorneys, Simpson Millar, this is an enormous victory for patients with mesothelioma. The majority of Navy personnel and a large number of civilians, were docked at US ports throughout their career where they were exposed to harmful asbestos fibres. This is due to the widespread use of asbestos on American ships during this time. Mesothelioma symptoms can take decades to show up and, as a consequence that veterans are often left with fewer options to seek compensation.

The Ministry of Defence has confirmed that veterans with mesothelioma who have never received an entitlement to a war pension will now receive a lump sum amounting to PS140,000. This will be a significant increase over the amount that non-married veterans suffering from mesothelioma receive under the Diffuse Mesothelioma scheme.

However, this new payment will be taken from any existing war pension an individual receives. This means it is essential that anyone diagnosed with mesothelioma who is considering applying for this new payment seeks the advice of experienced mesothelioma lawyers to ensure they get the right deal.

It is a win for the Royal British Legion

The Royal British Legion has delivered a stinging rebuke to the government over claims that it hasn't acted on its promise to establish the military covenant in law. The charity has asked the minister to explain why the government isn't honouring its commitment to veterans. It has also threatened to withdraw from various forums that it has worked with the Ministry of Defence.

Engagement of the Legion with the MoD is essential however, it needs to be more efficient to ensure the community's needs are met in a manner that has a positive impact on their lives. It is therefore vital that the feedback loop within forums is improved to ensure that any issues that are consistently not addressed are identified and the reasons for this are clearly explained.

As the country's oldest and largest Armed Forces charity, the Royal British Legion is at the center of the national network that provides assistance to members of the Armed Forces and their families. They are also the organization which is the best placed to understand the challenges that those who serve and have served as well as their widows and widowers.

The fact that patients with mesothelioma are often left with no financial security is among their biggest worries. The amount of compensation offered isn't always enough to cover living expenses or medical costs, and mortgages are often impossible to obtain.

Asbest was used in shipbuilding in addition to other Naval activities. This has left many veterans struggling to cope with the symptoms of their illness and the impact on their financial health.

There are numerous organizations that can assist. For instance, mesothelioma lawyers can help to secure legal compensation for sufferers, which can be used to pay for treatment or cover the essential expenses of living. Mesothelioma sufferers may also seek compensation from the companies who supplied asbestos-containing products.

It will be welcomed by veterans

Navy veterans who are diagnosed with mesothelioma are eligible to receive a lump sum of PS140,000 according to the Ministry of Defence has announced. This will allow them to have significant financial support to ease the financial burden that mesothelioma causes their families.

This news will be greeted by the thousands of former service personnel diagnosed with mesothelioma. The law has been modified so that they can be paid the same amount as civilian sufferers with mesothelioma compensation claims.

The change came about in response to an effort by the Royal British Legion, and other groups. This led to the Prime Minster declaring that he would investigate the issue. The U-turn by the MoD will allow many dying veterans, who could have been eligible for a war-related pension to pick lump sum. This will give them the peace of mind they need as well as the financial assistance they need to live out the rest of their life.

Asbestos exposure is linked to mesothelioma. It can take decades for symptoms to manifest but even a single exposure can increase the risk of developing the condition. The majority of mesothelioma patients were exposed to asbestos while working, and this includes in Navy shipyards. The UK law was changed in the last year to allow workers to sue employers if they were exposed to asbestos on the job however, many veterans are still unaware that they can seek compensation from the government.

Mesothelioma is a devastating illness that has affected many lives. The decision of the government regarding how to address the unfair treatment of veterans is a major victory.

But it's not enough to end the suffering of mesothelioma patients as well as their families. They also need to seek compensation from the companies that supplied asbestos-related products to the armed forces. Veterans could file trust fund claims against a variety of different corporations based on where they worked, including shipyards, bases, and ships. These could include large multinationals who have a long history of selling asbestos products to the US Navy or other branches of the military.
