A New York-based firm settled a IER charge that it discriminated against an Asylee employee. The company did not provide her with employment based on her citizenship or immigration status. The settlement stipulates that the company has to pay an administrative penalty, educate its employees in the area of 8 U.S.C. Section 1324b, and be subject to Department of Labor monitoring for three years.

On November 7 2018 IER entered into a settlement with MJFT Hotels of Flushing LLC which runs the Hyatt Place Flushing/Laguardia Airport hotel, to settle a complaint alleging that it discriminated against a worker-authorized immigrant in its hiring process. The settlement demands that MJFT pay a civil penalty and train the employees concerned in accordance with 8 U.S.C. Section 1324b, submit departmental reporting and monitoring for three years, and amend its policy to exclude work-authorized immigrants applicants.

Product Liability Settlements

Union Pacific is a major railroad with 32,000 route miles that transports goods like food, chemicals, coal minerals, metals, intermodal transport, and automobiles. The company made $16.1 billion in profits in 2011.

According to its safety guidelines, anyone who is at risk of becoming disabled or is in danger of being incapacitated should not work on the railroad. Jim Kaster, an EEOC attorney has told CNBC that Union Pacific is under investigation for alleged violations of the Americans with Disabilities Act.

Eric Doi, the plaintiff in this case, was part of a zone group that travelled on a need-to-know basis between states to perform work for railroads. He suffered injuries when he was involved with a different Union Pacific truck driver in a rollover accident.

Doi claimed that Union Pacific was negligent in many ways, including failing to properly supervise and educate its employees. Doi also claimed that Union Pacific did not follow industry standards and provided appropriate safety procedures. He was awarded $557 million by the jury.

A portion of the $557 million award will also be used for his future medical expenses. The court will also issue an order that requires railroad officials to ensure that the members of the gang's zone are properly educated and equipped with the safety equipment and procedures required to operate their vehicles.

Hallman who was Torres's legal advisor, sought the court's approval for the settlement in accordance to Code of Civil Procedure fn. 1 section 877.6 which states that courts must accept settlements that are made in good faith.
