A New York-based company has settled an IER charge that it discriminated against an employee who was an Asylee. The company did not offer her employment based on her citizenship or immigration status. The settlement stipulates that the company has to pay an amount of civil penalties, and to instruct its employees in 8 U.S.C. Section 1324b and to be subject to Department of Labor monitoring over three years.

IER and MJFT Hotels of Flushing LLC reached a settlement on November 7 on the 7th of November. The settlement was made to settle a lawsuit alleging that IER discriminated against a work-authorized immigration worker in its hiring process. Union Pacific Cancer Cluster stipulates that MJFT to pay an administrative penalty of a civil nature, educate employees on the requirements of 8 U.S.C. Section 1324b, submit departmental monitoring and reporting for three years, as well as change its policy excluding work-authorized immigrant applicants.

The plaintiff in this case, Eric Doi, worked as a member of a zone gang who moved on a regular basis between and within various states to do work for the railroad. He was injured when it was involved in a rollover accident with another Union Pacific truck driver.

Doi claimed that Union Pacific was negligent in many ways, including failing to supervise and train its employees properly. Doi also claimed that the railroad did not provide proper safety procedures and failed to follow recognized industry standards. He was awarded $557 million by the jury.

In addition to the $557 million award part of the money will go toward his future medical treatment. The court will also make an order requiring the railroad to take actions to ensure that zone gang members are properly trained and equipped with the necessary safety equipment and procedures to operate their vehicles.

Hallman who was Torres's legal counsel and sought the court's approval of the settlement in accordance with Code of Civil Procedure fn. 1 section 877.6 which states that courts must approve settlements that are made in good faith. The trial court ruled that both parties' settlements were in good faith, and therefore did not constitute an unfair or fraudulent act.

Medical Malpractice Settlements

Another case involved a patient who suffered kidney damage after her condition was misdiagnosed by doctors. The doctor did not request an MRI or perform blood tests. She was then operated upon without knowing what was wrong and resulted in permanent kidney damage.

Similar to the other case, it was a case of a man who suffered serious injury after sustaining a knee injury during an accident at work. Union Pacific Cancer was able to recuperate some of his earnings but the damage to his body and his career were significant. Additionally, he needed undergo surgery to repair his knee.
