A company located in Rome, New York agreed to settle a dispute with IER that it discriminated against an asylum-seeking worker by not referring her for employment due to her citizenship or immigration status. The settlement demands that the company pay a civil penalty, train its employees about 8 U.S.C. Section 1324b and be subject to Department of Labor monitoring for three years.

On November 7, 2018, IER reached a settlement with MJFT Hotels of Flushing LLC which manages the Hyatt Place Flushing/Laguardia Airport hotel. The settlement was to settle a complaint alleging that it discriminated against a worker-authorized immigrant in its hiring process. Union Pacific Cancer Cluster stipulates that MJFT to pay a civil penalty, train relevant employees on the requirements of 8 U.S.C. Section 1324b. It also requires departmental monitoring and reporting for three years, and change its policy on excluding work-authorized applicants.

Product Liability Settlements

Union Pacific is a major railroad with 32,000 route miles that transports items such as coal, chemicals, food minerals, metals, intermodal transportation, and automobiles. In 2011, the company earned $16.1 billion in earnings.

Its safety policies say that anyone with more than a slight risk of "sudden incapacitation" should not be employed by the railroad. The lawyers for the railroad are arguing that these regulations are designed to protect employees and the public from potential injuries and environmental damage caused by a derailment or accident. But former employees are claiming that the company is not following doctors' advice and making its own decisions, especially when doctors have stated that their former employees are safe to work.

Union Pacific denied a custodian job to an employee with brain tumour, according to a suit filed with the Equal Employment Opportunity Commission. EEOC attorney Jim Kaster told CNBC that the agency is currently investigating Union Pacific's conduct, which violates the Americans with Disabilities Act.

The plaintiff in this case, Eric Doi, worked in a gang called a zone that worked on an as-needed basis between various states to perform work for the railroad. He sustained injuries when he was involved in a collision with another Union Pacific truck driver in an accident that involved a rollover.

Doi claimed that Union Pacific was negligent in numerous ways, including failing to properly supervise and train its employees. He also claimed that the railroad was unable to provide proper safety procedures and also failed to follow recognized industry standards. He was awarded $557 million by the jury.

A portion of the award of $557 million will also go towards the future medical treatment of the patient. The court will also issue an order that requires railroad officials to ensure that the members of the gang's zone are properly trained and have the safety equipment and procedures they require to operate their vehicles.

Hallman, who acted as Torres's legal counsel sought the court's approval of the settlement in accordance with Code of Civil Procedure fn. 1 section 877.6, which provides that the courts must accept settlements that are not done in bad faith. The trial court ruled that the settlements reached by both parties had been made in good faith and therefore, did not constitute fraud or unfairness.

Medical Malpractice Settlements

Union Pacific, the largest railroad in the United States, is the subject of numerous lawsuits filed by former employees who claim the company failed to safeguard them from workplace hazards. While these workers make up only a tiny portion of the more than 30,000 employees of Union Pacific, their claims could be costly for the railroad.

Another case also involved a man suffering serious injuries when his knee was injured during an accident at work. He was able recover a portion of his wages however the damages to his body and career were substantial. He also required surgery to fix his knee.
