What Does The Montana State Insurance Commissioner Doesn?
The Montana State Insurance Commissioner is an elected state official in the state of Montana. The commissioner is elected annually, concurrent with the Montana's gubernatorial race and the national election of the United States President.
He serves as the chief executive officer of the Montana Association of Insurance Reviewers, which administers the MLS. There are two primary ways in which the MLS regulates the companies that provide auto, home, health, and life insurance in Montana. The insurance regulators can either issue a policy or rule on behalf of the MLS. They can either enforce the Code or refer cases to the Attorney General to rule on behalf of the MLS.
In both cases, the Commission will follow the policies set forth in the Montana Code, and state laws, which are generally very specific and difficult for the lay person to understand. Even the Commissioners cannot change these policies or interpret them themselves. The Commission is required to file an annual report with the Secretary of State's office, detailing their findings and recommendation on the status of the insurance business.
For example, the Commission might find that the company does not follow the Code in terms of providing a policy to its clients, and so the Commission may decide to refer the case back to the Attorney General for legal assistance. In some cases the Commission may find that the company does have been cited in a number of different violations of the Code, and therefore they need to refer the case back to the Attorney General.
In addition, there is no set number of complaints and violations that can be reported. In many instances the Commission does not even know that the company is being cited. as their investigators may not have even met with the business.
The policy and code in question are very technical and difficult to understand, and so it is up to the Commissioners to the Commission to explain the policy and code in a simple and understandable manner for all of their clients. This includes explaining how to use the Internet to research the Code, and the various different types of policy that are available for businesses.
In many cases the Commission has to deal with other matters besides investigating auto insurance. In some states the Commission can recommend changes in the Code and state law related to the use of agents and brokers.
As with all commissions, the Insurance Commission is required to make a quarterly audit of their performance and the status of the business. For elevate-insurance , the Commission makes recommendations to the Secretary of State for any changes that need to be made to the Code or the state law.
