Sun Life - An Insight Into Their Claims Process
A lawsuit was filed against two Sun Life Insurance companies in Toronto and is currently being fought in the Ontario Superior Court of Justice. The complainants are SunLife Corporation and its wholly owned subsidiary, Sun Life Insurance of America (Sun Life of USA). The plaintiffs are Sunlife Insurance of America and its subsidiary SunLife Assurance of America.
SunLife, a large Canadian-based insurer, is the second largest provider of health and accident insurance in Canada after Canadian Pacific. The lawsuit claims that SunLife and their subsidiary Sunlife Assurance of America violated the Canadian Competition Act by imposing unreasonable restrictions on the distribution of the risk between themselves and other insurers in the United States.
SunLife and their subsidiaries have been accused of engaging in practices that were designed to raise the premiums paid by clients in the United States to increase their profits. For instance, by requiring a person applying for a policy in the United States to pay a higher premium if they have a history of heart problems or have smoked cigarettes for a period of time, SunLife has been accused of discriminating against applicants based on a pre-existing medical condition. The plaintiff claims that SunLife is also guilty of charging higher premiums for policy holders who have recently had surgery or suffer from certain types of illness.
SunLife is also accused of violating the law by offering policies to clients in the United States that do not comply with certain aspects of the law. These include requiring that the client obtain specialized medical training, requiring that the client undergo several medical examinations prior to receiving a policy, requiring the client to pay an exorbitant monthly premium for an "investor's" protection and prohibiting them from participating in certain activities like participating in a group plan.
SunLife denies these accusations. The company says that the charges that the complaint makes are based on speculative calculations and the policy holders that have filed suit have actually chosen a low percentage of people who are likely to sue in an attempt to raise their premiums. SunLife's claim to be a non-discrimination organization is "ridiculous," according to the SunLife attorney.
SunLife and their subsidiary SunLife of America have the distinction of being a member of the National Association of Professional Life Agents (NALA), which is considered to be an organization of the American Insurance Industry (AII). The organization's primary function is to protect the interests of individual agents in a manner similar to the AIA.
SunLife also claims that a SunLife of America claims that they have a "no-fault" system where an applicant for a policy is not required to provide any type of evidence of prior medical conditions to receive a policy, is incorrect. They also say that their policies are designed to protect the interests of policyholders in the same way that the AIA are designed.
In the end of the lawsuit, both parties are expected to reach an agreement that is agreeable to each party, as well as financially beneficial to both parties. The lawsuit is being handled in the Ontario Superior Court of Justice. If both sides reach an agreement, a settlement agreement will be made public and the case will be closed.
SunLife and their affiliates must maintain their policies. SunLife's lawyers must also advise their clients of the right to file a claim for compensation, and the right to receive damages if they are found to have been the victim of an accident caused by the negligence of a SunLife policyholder. If a claim is filed against a SunLife of America policyholder, his or her policy is considered to be in default and is usually foreclosed upon.
SunLife has been in the life insurance business since the nineteen eighties. Their claims process was developed by Richard S. Gage, who later founded the AIA.
