The Diffuse Mesothelioma Payment Scheme Regulations 2014
In January 2014 the government passed legislation establishing a mesothelioma compensatory scheme funded by a levy on insurers. This scheme will pay compensation to patients with mesothelioma diffuse if they cannot identify a former employer or an insurer who is accountable for their asbestos exposure.
Anyone who is unsuccessful in their application may request the decision be reviewed. The tariff tables below provide more details about this process.
What is the DMPS (Digital Media Payment System)?
The Diffuse Mesothelioma Payment Scheme (DMPS) was launched in 2014 as part of the Mesothelioma Act 2014. The scheme is a solution to an insufficiency that previously meant that sufferers who could not trace their employer, or even their insurer's employer, were unable to claim compensation. It was described at the time as a'scheme of last resort' and the Forum applauded the introduction of this scheme, especially as it closed a loophole that permitted asbestos victims to be denied the financial support they deserve.
It is a lump-sum payment for those with diffuse mesothelioma diagnosed who are unable pursue a civil case through the courts. It is funded by an insurance levy that is levied on employers' liability insurers and is administered by Gallagher Bassett before it was taken over by TopMark Claims Management Limited in 2018. The DMPS scheme operates a tariff system where the amount of the lump sum is contingent on the age at which you were diagnosed with mesothelioma.
If your DMPS claim is approved and you are in receipt of your funds within six weeks after your claim is processed. In addition, you'll also receive a contribution towards legal expenses of PS7,000. Your solicitor will help you complete the DMPS application form and collect the required supporting documents such as evidence of unsuccessful attempts to locate your employer or their insurer through the Employer's Liability Tracing Office.

However, there is a separate program that allows this expense to be covered in civil lawsuits. This should be addressed as a matter of urgency if any victim is to make the best possible financial recovery for their asbestos-related illness. How do I submit an application to the DMPS?
You can include the name of another person in your DMP in the event that you have debts in your name or in joint names. The creditors of the other person can still pursue them in the event that the debt isn't paid in the full amount.

What happens if not successful?

In February 2015 the DMPS tariff payment was raised to PS240,000 for individuals who were diagnosed with mesothelioma on or after 10 February 2015. The increase was a a result of the judgment in DP v Topmark Claims Management Ltd (2020) UKUT 0106 (AAC). This is the first time that the DMPS is examined at appellate level and provides some useful guidelines on its scope.
