What is the DMPS?

The Diffuse Mesothelioma Payment Scheme (DMPS) was introduced in 2014 as part of the Mesothelioma Act 2014. This scheme fills an area that had previously hindered those who were unable to locate their employer or insurance company's employer from seeking compensation. It was described at the time as a 'scheme of last resort'. The Forum was pleased with its introduction, particularly as it closed a loophole that allowed asbestos sufferers to be left without the financial assistance they need.

It is an amount in one lump sum to compensate those diagnosed with mesothelioma diffuse who cannot pursue a civil lawsuit through the courts. It is funded through an insurance levy on insurers of employers' liability and administered by Gallagher Bassett before it was taken over by TopMark Claims Management Limited in the year 2018. The DMPS scheme is a tariff system where the level of the lump sum is based on the age at which you were diagnosed with mesothelioma.

If your DMPS claim is approved and you are eligible to receive your money within six weeks after your claim is processed. Additionally, you will also receive a portion of legal expenses of PS7,000. However, there is a separate program that allows this expense to be covered in civil claims. This must be taken care of as a matter of urgency if any victim is to achieve the highest possible financial recovery from their asbestos-related illness.
