What is the DMPS?

The Diffuse Mesothelioma Payment Scheme (DMPS) was introduced in 2014 as part of the Mesothelioma Act 2014. This scheme fills an area that had previously hindered those who were unable to locate their employer or insurance company's employer from seeking compensation. It was described at the time as a 'scheme of last resort'. The Forum was pleased with its introduction, particularly as it closed a loophole that allowed asbestos sufferers to be left without the financial assistance they need.

It is an amount in one lump sum to compensate those diagnosed with mesothelioma diffuse who cannot pursue a civil lawsuit through the courts. It is funded through an insurance levy on insurers of employers' liability and administered by Gallagher Bassett before it was taken over by TopMark Claims Management Limited in the year 2018. The DMPS scheme is a tariff system where the level of the lump sum is based on the age at which you were diagnosed with mesothelioma.

If your DMPS claim is approved and you are eligible to receive your money within six weeks after your claim is processed. Additionally, you will also receive a portion of legal expenses of PS7,000. Your solicitor will assist you in filling out the DMPS form and obtaining the necessary supporting documentation, such as proof of unsuccessful attempts to locate your insurer or employer through the Employer's Liability Tracing Office.

There is also no provision for legal fees which must be paid by those who are pursuing an DMPS application. However, there is a separate program that allows this expense to be covered in civil claims. This must be taken care of as a matter of urgency if any victim is to achieve the highest possible financial recovery from their asbestos-related illness. How do can mesothelioma lawsuit payout apply for the DMPS for a DMPS card?

It is a scheme paid for by a levy imposed on the insurance policies of employers' liability. The DMPS has been in operation since April 2014. It is able to award payments up to PS240,000 for each person.

In order to apply for a loan you must meet certain deadlines. This includes the date of first diagnosis of mesothelioma and a time limit of three years from that point. The increase was in response to the judgement in DP v Topmark Claims Management Ltd (2010) UKUT 0106(AAC). This is the first time that the DMPS is being considered at appellate level and provides useful guidance as to its scope.
