10 Meetups About Diffuse Mesothelioma Payment You Should Attend
The Diffuse Mesothelioma Payment Scheme Regulations 2014

In January 2014, the government passed legislation that established a mesothelioma compensation scheme that is funded by an insurance tax. This scheme pays compensation for those suffering from diffuse mesothelioma, who are unable to identify a former employer or an insurer, who is accountable for their asbestos exposure.

If applicants aren't satisfied with the decision can ask for a review. Tariff tables below provide more details on this procedure.

What is the DMPS (Digital Media Payment System)?

In 2014 the Mesothelioma Act included a new scheme for payment of mesothelioma diffuse. The scheme fills in an area that had previously hindered those who could not locate their employer or insurance company's employer from seeking compensation. It was referred to as a'scheme of last resort'. The Forum welcomed its introduction, especially because it closed a loophole that permitted asbestos victims to be denied the financial assistance they need.

It is a lump-sum payment for patients with mesothelioma diffuse diagnosed but who are not able to take a civil case to the courts. The scheme is funded by an insurance company's liability tax and was administered by Gallagher Bassett until it was taken over in the year 2018 by TopMark Claims Management Limited. The DMPS scheme uses an underlying tariff system, where the amount of the lump amount is determined based on your age at the point you were diagnosed with mesothelioma.

If you're successful in your DMPS application and you are successful, you will receive your funds within six weeks of the time your claim is processed. Additionally, when mesothelioma lawsuit payout will be eligible for a contribution to legal expenses of PS7,000. Your solicitor will assist you in completing the DMPS form and obtaining the necessary documents, including evidence of unsuccessful attempts to locate your employer or insurer through the Employer's Liability Tracing Office.

Although it is possible to submit a DMPS application yourself, you will need a specialist mesothelioma lawyer to guide you through the process and ensure that the information you provide is accurate. The lawyer will assist in providing a detailed job history and explain the circumstances that caused asbestos exposure and how it impacted your life.

It is essential that all information on the DMPS form is accurate, as failure to complete the form correctly could result in your application being refused. Applicants will receive a letter that will inform them if they're successful or not. The funds will be paid directly to your bank account. If you are not successful in your claim, you may be eligible to appeal the decision.

Who is eligible to receive a DMPS Payment?

The DMPS was a major improvement for those suffering from mesothelioma at the time it was first introduced, particularly because it can take many years for asbestos-related diseases to develop. The scheme fills a gap that previously allowed asbestos patients to claim compensation from their former employers and insurers.

But, four years later, it must be questioned whether the DMPS is sufficient and if more should be taken to ensure that those who cannot pursue a civil suit are still able to receive the compensation they deserved for their exposure to asbestos. It should be noted that the DMPS only provides compensation to mesothelioma patients and those financially dependent on them, not the Estate of someone who has died from the disease or who were exposed to asbestos on a second basis, for example, wives who washed their husbands' clothes for work or who are exposed to environmental hazards or do not know who they worked for.

The scheme also only allows three years to pass from the date of diagnosis, compared to the three-year statute of limitations for civil claims. This puts certain victims in a disadvantage as it means they do not have the opportunity to claim for costs like treatment with immunotherapy which has been proven to significantly increase the life expectancy of some instances, but is not accessible on the NHS and can cost up to PS280,000.

Finally, there is no allowance for legal fees to be paid by those pursuing a DMPS application whereas there is a separate program which allows for this cost to be covered in civil claims. This must be addressed as a matter urgent importance if a victim wishes to make the best possible financial recovery for their asbestos related disease. This can be achieved through the assistance of an expert solicitor who can submit a claim to the SSCS6a to request review (or "mandatory reconsideration") of any decision made by the Scheme Administrator.

How do I apply to the DMPS for a DMPS card?

If you have debts in your name or joint names with another you may include the other person's name in your DMP. The creditors of the other will still pursue them if the debt is not paid in complete.

Some people have tried using DMPS transdermally (by applying it on the skin) or by sniffing. However, this is not an appropriate method of administration since DMPS is water-soluble. Additionally, it is a reactive oxygen and could be degraded quickly. It is only administered either by oral or intravenously. [14] DMPS must also be fat-soluble to be active in the lymphatic system.

What happens in the event that my application is rejected?

The DMPS is an insurance-funded compensation scheme, which was introduced by the Mesothelioma Act 2014. It pays out to those diagnosed with diffuse mesothelioma, and their dependents, who were exposed to asbestos while working in the UK. The scheme is funded by an levy on employers and liability policies. The DMPS is in operation since April 2014. It can pay out payments of upto PS240,000 for each person.

To apply for a payment you must meet certain deadlines. This includes the date of the first diagnosis of mesothelioma, and a time limit of three years from the date of diagnosis. If you have been diagnosed with mesothelioma and can trace your liable former employer or their Employers' Liability insurance then it is worth applying as soon as possible.

If your application is rejected You can request a reconsideration by the Scheme Administrator. This can be done by filling out an DMPS Request for Reconsideration form. It is crucial to speak with a solicitor throughout this procedure. They can help you complete the application on your behalf, help in gathering documents, and provide support at all stages.

If you aren't satisfied with the outcome of the review, you may appeal to the First Tier Tribunal which is part of the Tribunal Service. It is important that you seek legal advice as soon as you can if you intend to appeal.

Immunotherapy and other treatments are proving to be very effective in prolonging the lives of those diagnosed with mesothelioma. However they are very expensive and are not available on the NHS. Some patients may opt to file a civil lawsuit for reimbursement to fund their treatment.

In February of 2015, DMPS tariff payments were increased to PS240,000 for mesothelioma patients diagnosed after or on 10 February 2015. The increase was made in response to the ruling in DP v Topmark Claims Management Ltd (2010) UKUT 0106(AAC). This is the first instance that the DMPS was considered as an appellate matter and provides some helpful guidelines regarding its scope.
