What is the DMPS (Digital Media Payment System)?

In 2014, the Mesothelioma Act included a new scheme for payment of mesothelioma that is diffuse. This scheme fills in an area that had previously hindered those who were unable to find their employer or their insurance company's employer from making claims for compensation. It was referred to as a'scheme of last resort'. The Forum was pleased with the introduction of this scheme, especially as it closed a loophole that permitted asbestos victims to be left without the financial support they deserved.

It is a lump sum payment for those with diffuse mesothelioma diagnosed who are unable pursue a civil case through the courts. It is funded through an insurance levy on insurers of employers' liability and is administered by Gallagher Bassett before it was taken over by TopMark Claims Management Limited in 2018. The DMPS scheme operates on a tariff system, where the amount of the lump sum is determined by your age at the time that you were diagnosed with mesothelioma.

If you're successful in your DMPS application, you will receive funds within six weeks of the time your claim is processed. In addition, you will be eligible for a contribution to legal costs of PS7,000. Your lawyer will assist you complete the DMPS application form and gather the necessary supporting documents like proof of unsuccessful attempts to locate your employer or their insurer via the Employer's Liability Tracing Office.

You can make an DMPS request yourself, but you'll need a lawyer with expertise in mesothelioma to guide you and ensure that all the information you provide is correct. The lawyer will assist you to provide a detailed work history and also explain the circumstances that led to your exposure to asbestos, and how it affected your life.

All information must be correct on the DMPS application form. If not, your application may be refused. Applicants will receive a letter that will inform them if they're successful or not. The funds will be transferred directly to your bank account. If you do not receive a positive outcome you may appeal the decision.

Who is eligible to receive a DMPS payment?

The DMPS was an important improvement for those suffering from mesothelioma when it was launched, particularly because it can take an extended time for asbestos-related illnesses to develop. The scheme fills in a gap that previously permitted those who couldn't find their former employers or their insurers to recover compensation for exposure to asbestos and has been well-received by mesothelioma patients and their families.

Four years later, it's time to question whether the DMPS will be sufficient to pay those who are not able to bring a civil action for asbestos exposure. The DMPS does not pay out to people who died from mesothelioma or were exposed at a second level like those who cleaned the clothes of their husbands or to those who suffered from exposure to the environment.

The scheme also allows three years from diagnosis to apply, versus the three years that are the statute of limitations in civil lawsuits. This leaves some victims at disadvantage since they don't have the chance to claim expenses such as the treatment of immunotherapy that has been proven to dramatically improve life expectancy in some instances, but is not available on the NHS and can cost as much as PS280,000.

Finally, there is no allowance for legal fees that must be paid by those who are pursuing an DMPS application whereas there is a separate scheme that allows this cost to be covered in civil cases. If asbestos-related diseases are to be treated as efficiently as possible, this issue must be addressed quickly. This can be accomplished through the use of an expert solicitor who will submit a claim to the SSCS6a to request a review (or mandatory reconsideration) of any decision made by the Scheme Administrator.

How do why mesothelioma asbestos claim payouts apply for the DMPS for a DMPS card?

It is a scheme that is funded by a levy on insurance policies for employers' liability. The DMPS has been in operation since April of 2014 and it can award payments up to PS240,000 per person.

There are certain time limits that must be observed in order to make an application for an amount. This includes the date of first diagnosis of mesothelioma and a deadline of three years from the time of diagnosis. If you've been diagnosed with mesothelioma and can find your former employer or their Employers Liability Insurance, you should consider applying as soon as you can.

If your application is not successful If your application is rejected, you can request the Scheme Administrator to conduct an appeal of the decision. This can be done by completing a DMPS Request for Reconsideration Form. It is essential to consult with a lawyer throughout the procedure. If you are not happy with the outcome of the review, you may appeal to the First Tier Tribunal which is part of the Tribunal Service. It is essential to seek legal advice as soon as possible should you decide to appeal.

Immunotherapy, in conjunction with other treatments that are new, is showing great potential to extend the lifespan of patients diagnosed with mesothelioma. However, these treatments are currently very expensive and they are not available on the NHS. Therefore many sufferers choose to file a civil lawsuit for compensation to pay for their treatment and recover costs.

In February of 2015, DMPS tariff payments were increased to PS240,000 for those diagnosed with mesothelioma at or after the 10th of February 2015. The increase was a a result of the judgment in DP v Topmark Claims Management Ltd (2020) UKUT 0106 (AAC). This is the first instance where the DMPS was examined at an appellate level, and provides some useful guidelines on its scope.
