What is the DMPS?

The Diffuse Mesothelioma Pay Scheme (DMPS) was introduced in 2014 as part of the Mesothelioma Act 2014. This scheme fills in a gap that previously prevented those who could not find their employer or their insurer from making claims for compensation. It was described at the time as a'scheme of last resort'. The Forum was pleased with its introduction, particularly as it filled a loophole which allowed asbestos sufferers to be left without the financial assistance they need.

It is a lump-sum payment for patients with mesothelioma diffuse diagnosed, who are unable to pursue a civil case through the courts. The scheme is funded by an insurance company's liability levy and was administered by Gallagher Bassett until it was taken over in the year 2018 by TopMark Claims Management Limited. The DMPS scheme operates on the tariff system, in which the amount of the lump amount is determined by your age at the time that you were diagnosed with mesothelioma.

If you are successful in your DMPS application and you are successful, you will receive your funds within six weeks of the time your claim is processed. In addition, you'll also receive a contribution towards legal expenses of PS7,000. Your solicitor will assist you in completing the DMPS form and obtaining the required supporting documentation, such as proof of unsuccessful attempts to find your employer or insurer through the Employer's Liability Tracing Office.

You can submit an DMPS request on your own, but you'll need a specialist lawyer with expertise in mesothelioma. They will guide you and ensure all the information you provide is correct. Who is eligible to receive a DMPS Payment?

It must also be noted that the DMPS only makes payments to mesothelioma patients and those financially dependent on them, not the estate of someone who has died from the disease or those who were exposed to asbestos on a secondary basis, such as wives who washed their husbands' work clothes, or those who were exposed to asbestos in the environment or have no idea who they worked for.

The scheme also allows for three years from diagnosis to apply, versus the three-year period that is the statute of limitations in civil claims. This leaves some victims in an awkward position, since they are not able to claim costs like immunotherapy treatments, which can be costly and can cost up to PS280,000.

Finaly, the DMPS does not cover legal fees. However payout for mesothelioma victims allows these costs to be covered for civil lawsuits. This must be addressed as a matter of urgent importance if a victim wishes to make the best possible financial recovery for their asbestos-related illness. How do I make an application to the DMPS?

If you have debts in your name or joint names with someone else you can add the name of the other party in your DMP. However, the other's creditors will continue to pursue them for the debt, unless it is paid in full by one person.

Some people have tried using DMPS transdermally (by applying it on the skin) or by sniffing. This is not a great method of administration since DMPS is easily soluble in water. It is also highly reactive to oxygen and is likely to degrade quickly. It can only administered either by mouth or intravenously. [14It is not administered intravenously. DMPS must be fat-soluble to function in the lymphatic system.

What happens if I am not successful?

The Mesothelioma Act 2014 introduced the DMPS which is a compensation scheme funded by insurers. It provides compensation to patients of mesothelioma diffuse and their dependants who have been diagnosed with this incurable cancer because of exposure to asbestos while in employment in the UK. The scheme is that is funded by a levy imposed on insurance policies for employers' liability. The DMPS is in operation since April 2014 and can be awarded payments of up to PS240,000 per person.


To be eligible for a loan you must follow certain deadlines. The date of the first diagnosis of mesothelioma and a deadline of three years from that date are included. If you have been diagnosed with mesothelioma, and you are able to trace your liable former employer or their Employers' Liability insurance then it is worth applying as soon as possible.

If your application is unsuccessful, you can ask the Scheme Administrator for an appeal to the decision. This can be done by filling out an DMPS Request for Reconsideration form. It is important to consult an attorney throughout the process. They can complete the application on your behalf, assist you in gathering the required documents, and help you throughout the process.

If you're not satisfied with the result of the review, you can appeal to the First Tier Tribunal. This is part of the Tribunal Service. If you wish to appeal, it is important to seek legal advice as soon as you have the possible time.

Immunotherapy and other treatments are proving to be very effective in extending life expectancy for those diagnosed mesothelioma. The treatments are expensive and are not accessible through the NHS. As a result, some sufferers will choose to file a civil suit for compensation to fund their treatment and recover costs.

In February 2015, DMPS tariff payments were increased to PS240,000 for those diagnosed with mesothelioma after or on 10 February 2015. The increase was made in response to the ruling in DP v Topmark Claims Management Ltd (2010) UKUT 0106(AAC). This is the first time the DMPS is being examined at appellate level and provides some helpful guidelines on its scope.
