In response to the recommendation that was made, the Home Treatment Team performed a comprehensive assessment of Miss Kelly's present functioning and mental state. The review included a comprehensive medical history and physical examination. The review also included a thorough psychotherapy assessment, a family therapy assessment and a psychiatric diagnosis interview.

According to the report Miss Kelly was afflicted by a range of mental health issues, including borderline personality disorders, bulimia, and anorexia. She also had an addiction history to drugs and had experienced domestic violence. Stress, anxiety and depression exacerbated her symptoms. She was also diagnosed with bipolar affective disorder as well as schizophrenia-related disorder.

Elayaperumal claims that Medtronic intentionally discriminated against him because of his race and nationality. He claims that his poor performance review in June of 2000 and the denial to give him certain projects assignments were motivated by racism. Medtronic has not provided evidence that its decisions were based on these factors. The lower rating for Elayaperumal's performance did not cause any reduction in his compensation or benefits.
