The New Mexico Superintendent of Insurance was originally created as part of the state legislation passed to protect consumers in that state from unscrupulous insurance companies. Now the role of this appointed position is expanded beyond the protection of consumers and instead acts as an advocate for businesses. The Superintendent is charged with ensuring that the insurance market works effectively for the entire insurance community.
The New Mexico State Superintendent of Insurance is appointed by the state governor and holds the post without the possibility of being removed. The Governor appoints ten of twelve Superintendents and also appoints the Chairperson of the Board of Supervisors, which makes one of the highest ranking members of the Board of Supervisors.
If you want to become a member of the State Superintendent of Insurance then you will first have to be certified by the board before you can begin the application process. You will have to complete a written exam which is typically two hours long and is usually offered at a regional board office.
You must then sit for the licensing examination conducted by the Department of Insurance. In order to pass the exam you must have a minimum of five years of experience and pass it within the same state that you completed your state license examination in. Once you have passed the licensing exam and obtained your license, you will then have to complete an additional training course. Training courses can range from twelve to twenty-four weeks and once you have completed the course your license will be valid for up to twenty years.
The MLS license does not include a guarantee of the license but rather requires a demonstrated commitment to practicing the duties that are required by law. You will have to complete a professional indemnity policy when you apply for your MLS license and you will also have to obtain a continuing education certificate to maintain your MLS license. There are other states that require their licensees to take certain continuing education courses but New Mexico does not have any requirements for this.
New Mexico has a minimum coverage amount which is set at $1.8 million for every person in the state but you can increase your coverage amount by purchasing more than one policy. You are allowed to carry all types of policies from the same to none of them. In addition to having a personal liability insurance policy your company may also purchase a group policy if you desire and there is another policy holder in your business.
All policies purchased under the MLS system have to be underwritten by a New Mexico insurance company. You will pay the premiums on these policies along with any applicable taxes and the company deducts the insurance company for their services from their profits. This insurance company is allowed to deduct the cost of insurance claims from your profits as well and in turn pass these funds on to the insurance company's clients.
Your claim will go directly to the company and they will take care of processing the claim. If the insurance company makes a mistake and denies your claim you will be entitled to a refund and the client will receive reimbursement.
In order to obtain your New Mexico superintendent of insurance license you need to pass both the written exam and the field examination. You will also need to complete an additional exam for each business in which you currently work.
