In accordance with its safety rules that anyone who is at risk of becoming incapacitated or has a chance of becoming disabled should not work on the railroad. The company's lawyers argue that these rules are intended to protect employees and the general public from injuries and environmental damage caused by accidents or derailments. However, former employees are claiming that the company is ignoring doctors' advice and making its own decisions, often when doctors have stated that their former employees are safe to work.

According to a lawsuit filed by the Equal Employment Opportunity Commission, Union Pacific discriminated against an employee with a brain tumor when it refused to allow him to return to work as custodian. EEOC attorney Jim Kaster told CNBC that the agency is currently investigating Union Pacific's conduct which violates the Americans with Disabilities Act.

Eric Doi, the plaintiff in this case was a member of a zone group that traveled on a need-to-know basis between different states to work for railroads. He was injured when it was involved in a rollover accident with another Union Pacific truck driver.

Doi claimed that Union Pacific was negligent in many ways, including failing properly to supervise and educate its employees. Doi also claimed that Union Pacific failed to adhere to industry standards and did not provide proper safety procedures. He was awarded $557 million by the jury.

In addition to the $557 million settlement, a portion of the money will be used to fund the future medical treatment of the victim. The court will also make an order that requires the railroad to take actions to ensure that gang members in the zone are properly trained and equipped with the necessary safety equipment and procedures to operate their vehicles.

Hallman who was Torres's legal counsel was seeking the court's acceptance of the settlement in accordance with Code of Civil Procedure fn. 1 section 877.6, which states that courts must accept settlements that are made in good faith. In Texas, a jury just awarded a woman $557million in damages after she was struck by an Union Pacific train and suffered serious injuries. In addition to the damages she suffered from her injuries, she was awarded $3 million in damages for wrongful deaths.

Plaintiffs claim that Union Pacific knew of a defect in its track detector circuitry ten years prior to the collision, but did not fix it. The defect caused warning bells and lights to delay and led to the crash.

The plaintiffs also argue that the railroad company should have provided more training for its employees on how to avoid accidents like this. They also want the company to pay a $3.5 million civil penalty.

Another settlement came in the case of a person who was diagnosed with kidney damage due to doctors misdiagnosed her condition. The doctor did not make an MRI or conduct blood tests.
