While the USPTO claimed that the phrase wasn't sufficiently popular to warrant the status of a trademark, it did not indicate the origin of a product. However, the tribunal disagreed with USPTO and ruled in the favor of Lizzo.
The TTAB provided several instances of the phrase in clothing made by third-party companies however, it said that these use cases are "outweighed by the references in the majority of these uses to Lizzo," meaning her music is the most prominent association. Additionally, retailers have received takedown requests from Lizzo's attorneys and acknowledged that Lizzo has put in a reasonable effort to protect her trademark.
