如果是前列以外的事件，就屬於「任意調解事件」。 顧名思義，當事人可自己選擇是否在起訴前聲請進行法院調解程序。 第4點，當事人如果在開庭日當天無故缺席，法院並不會處罰，更不會派警察來抓人。 但可能會發生命一造辯論判決的效果，也就是法官只聽對方的主張來下判決。 換言之，就是無故缺席的一方在訴訟中完全放棄為自己辯白的機會。 當然，一造辯論判決不代表對方必勝，畢竟法官還是會審視對方的主張是否合理。
調解有無效或得撤銷之原因者，當事人得向原法院提起宣告調解無效或撤
銷調解之訴。 前項情形，原調解事件之聲請人，得就原調解事件合併起訴或提起反訴，
請求法院於宣告調解無效或撤銷調解時合併裁判之。 第五百條至第五百零二條及第五百零六條之規定，於第二項情形準用之。
但有下列各款情形之一者
，不在此限：
一、被告同意者。 五、該訴訟標的對於數人必須合一確定時，追加其原非當事人之人為當事
人者。 六、訴訟進行中，於某法律關係之成立與否有爭執，而其裁判應以該法律
關係為據，並求對於被告確定其法律關係之判決者。 被告於訴之變更或追加無異議，而為本案之言詞辯論者，視為同意變更或
追加。 鄉鎮市調解委員會調解成立，該調解結果經法院核定後，亦可產生以下之法律效果，與聲請法院進行調解之效果相同。 為了擴大這個制度的適用，民事訴訟法又作了第二次的修正，讓當事人在第二次的訴訟進行中，也可以經由兩造同意將案件移付調解。
三、被害人如採刑事附帶民事訴訟時，由於法院通常均待刑事判決後，再將附帶民事部份移至民事庭審理，故通常需耗費較多之時間進行訴訟。 根據民事訴訟法第138條規定，當文書通知無法送達當事人手上、也無法請人代收時，可以「寄存送達」的方式寄存在送達地的自治或機關，並以送達通知書通知當事人。
聲請調解者為刑事告訴乃論案件，若調解內容以給付金錢或其他代替物或有價證券為標的者，該調解書內容具有執行名義，可供強制執行。 經過雙方辯論後，民事訴訟流程變迎來宣判程序。
